HomeMy WebLinkAboutPC 99-15_-- PLANNING COMNIISSION RESOLUTION NO 99-15 i A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DIAMOND BAR MAKING FINDINGS, PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65401, THAT THE CITY'S FISCAL YEAR 1999-00 CAPITAL IMPROVEMENT PROGRAM (CIP) IS CONSISTENT WITH THE GENERAL PLAN AND RECOMMENDING APPROVAL TO THE CITY COUNCIL. A. Recitals. 1. California Government Code Section 65401 requires the Commission to review proposed public works projects for the ensuing fiscal year to determine compliance with the City's General Plan. 2. On April 18, 1989, the City of Diamond Bar was established as a duly organized municipal corporation of the State of California. 3. The City Manager of the City of Diamond Bar has prepared a proposed Capital Improvement Program and Budget for the City's 1999-00 Fiscal Year which briefly j' describes certain proposed public works improvement projects to occur during the 1999-00 Fiscal Year. The projects include, but are not limited to, street and highway improvements, traffic signal installations and modifications and park improvements. 4. This Planning Commission, on June 8, 1999 at a regularly scheduled meeting, discussed the City of Diamond Bar's Fiscal Year 1999-00 Capital Improvement Program, and the projects contained therein, and concluded said discussion prior to the adoption of this Resolution. B. Resolution. NOW, THEREFORE, it is found, determined and resolved by the Planning Commission of the City of Diamond Bar as follows: 1. This Planning Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the facts and evidence presented during the Planning Commission ; meeting regarding the City's Fiscal Year 1999-00 Capital Improvement Program, including oral and documentary evidence provided by City staff, the Commission, in accordance with the provisions of California Government Code Section 65401, hereby finds as follows: (a) The projects identified in the City's proposed Fiscal Year 1999-00 Capital Improvement Program is consistent with the General Plan adopted July 25, 1995; i i r'a`— _�— �--�.._n.......�_.�.vw„.-..�_�_,�..,�-,rte°�--it^•"I-r ��_���.�-==_.T---- ,_�-----,-_ .--..: _ _.-. ._.-_.-� (b) The proposed CIP projects comply with all other applicable requirements of State n law and local ordinances, regulations, and standards; and I,wld; �l (c) The proposed 1999-00 Capital Improvement Program is Categorically Exempt, pursuant to Section 15301, from the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder. 3. This Resolution 'shall serve as the Planning Commission's'report to the City Council regarding the'General Plan- conformity'of the proposed 'public works projects in the City's Fiscal Year 1999-00 CIP as required by California Government Code Section 65401. 4. Based on the findings and conclusions set forth above, this Planning Commission hereby recommends approval of the 1999-00 Capital Improvement Program as proposed which shall conform to Exhibit "A" dated June 8, 1999. The Planning Commission shall: (a) Certify as to the adoption of this Resolution; and (b) Forthwith transmit a certified copy of this Resolution to the City Council of the City of Diamond Bar for use in its deliberations regarding the City's budget. r', G• ADOPTEDAND APPROVED THIS 8TH DAY OF JUNE, 1999, BY THE PLANNING };r= COMMISSION OF THE CITY OF DIAMOND BAR.
