P.C. 95-9 A RESOLUTION OF THE PLANNING COMMISSION OF _ THE CITY OF DIAMOND BAR MAK NG FINDINGS PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65401 PERTADONG TO THE CITY'S PROPOSED FISCAL YEAR 1995-96 CAPITAL EVIPROVEMENT PROGRAM. A. Recitals. (i) California Government Code Section 65401 requires this Commission to review proposed public works projects for the ensuing fiscal year to determine compliance thereof with the City's General Plan. (ii) The City Manager of the City of Diamond Bar -has heretofore prepared a proposed Capital Improvement Program and Budget for the City's 1995-96 Fiscal Year which briefly describes certain public works of improvement proposed to occur during the I 1995-96 Fiscal Year. Said Projects include, but are not limited to, street and highway, " improvements, traffic signal installations and modifications and park improvements. (iii) This Commission conducted a duly noticed public meeting on June 12, 1995 on the City of Diamond Bar Fiscal Year 1995-96 Capital Improvement Program, and the projects contained therein, and concluded said discussions' prior to the adoption of this Resolution. B. Resolution. NOW, THEREFORE, the Planning Commission of the City of Diamond Bar does hereby find, determine and resolve as follows: 1. In all respects as set forth in the Recitals, Part A, of this Resolution. Bar was incorporated on April 18 1989 and is of Diamond p 2. Based upon the facts and evidence presented during the public meeting conducted by this Commission regarding the City's Fiscal Year 1995-96 Capital f Improvement Program; including oral and documentary evidence provided by City staff, this Commission, in accordance with the provisions of California Government Code Section 65360 and 65361, hereby finds as follows: (a) There is a reasonable probability that the public works projects identified in the City's proposed Fiscal Year 1995-96 Capital Improvement Program will be consistent with the General Plan proposal being considered and studied by the City; (b) There is little or no probability that the public works projects identified in the City's Fiscal Year 1995-96 Capital Improvement Program will be of substantial detriment to, or interfere with, the proposed General Plan; and (c) The proposed public works projects comply with all other applicable requirements of State law and local ordinances, regulations and standards. 4. The Planning Commission hereby finds that the proposed 1995-96 Capital Improvement Program as proposed has been determined to be Categorically Exempt, pursuant to Section 15301, from the California Environmental Quality Act of 1970,. as amended, and the Guidelines promulgated thereunder, and; 5. This Resolution shall serve as the Planning Commission's report to the City Council regarding the conformity of the public works projects proposed in the City's Fiscal Year 1995-96 Program as required by California Government Code Section 65401. 6. Based on the findings and conclusions set forth in paragraphs 1, 2, 3, 4, and 5 above, this Planning Commission hereby approves the 1995-96 Capital Improvement Program as proposed which conforms to Exhibit "A" dated June 8, 1995. 2 r, , 7. The Secretary to the Planning Commission shall: (a) Certify as to the adoption of this Resolution, and (b) Forthwith transmit a certified copy hereof to the City Council of the City of Diamond Bar for use in its deliberations regarding said Budget. ADOPTED AND APPROVED THIS 12TH DAY OF JUNE, 1995, BY THE PLANNING COMMISSION OF THE CITY OF DIAMOND BAR.
