I<=.- — - s_1_-,., ». ,..»....,,- - -- _ RESOLUTION NO. 94-21 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DIAMOND BAR RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF DIAMOND BAR ADOPT THE 1994 DRAFT GENERAL PLAN OF THE CITY OF DIAMOND BAR AND CERTIFY THE ENVIRONMENTAL IMPACT REPORT RELATED THERETO. Recitals 1. On April 18, 1989, the City of Diamond Bar was established as a duly organized municipal organization of the State of California. 2. The City of Diamond Bar heretofore initiated proceedings to adopt a General Plan pursuant to Title 7,'Division 1 of the California Government Code, Sections 65360 and 65361. 3. Pursuant to Section 65361, of the California Government Code, opportunities were provided for community participation throughout the process of creating the 5. The Planning Commission considered, individually and collectively, the six sections comprising the City of Diamond Bar's 1994 Draft General Plan, the related appendices and the Environmental Impact Report and addendum prepared in respect to the 1994 Draft General p d �.. 1 71Tll'VI'f_.7._., General Plan by the formation of a General Plan Advisory Committee (GPAC). Said GPAC was appointed by the Diamond Bar City Council to recommend components of the proposed 1994 Draft General Plan, and held 15 public hearings commencing January 11, 1994 and concluding on June 30, 1994 4. The Planning Commission of the City of Diamond Bar has conducted duly noticed public hearings with regard to the Diamond Bar 1994 Draft General Plan. The public hearings commenced on July 11, 1994 and were continued to the following dates: July 16, July 18, July 25, August 1, August 8, August 15, August 23, August 30, September 12, September 22, September 26, September 27, and finally concluded on October 17, 1994. In the course of the public hearings, the Planning Commission received and deliberated upon written and oral testimony VII''I from members of the public, City staff, State agencies, �J , local agencies, consultants and boards and commission of the City. 5. The Planning Commission considered, individually and collectively, the six sections comprising the City of Diamond Bar's 1994 Draft General Plan, the related appendices and the Environmental Impact Report and addendum prepared in respect to the 1994 Draft General p d �.. 1 71Tll'VI'f_.7._., Plan. The 1994 Draft General Plan incorporates the seven mandatory elements established in Government Code Section 65302 into six components, specifically: a. The Land Use Element; b. The Housing Element; C. The Resource Management Element (Open Space and Conservation Elements) d. The Public Health and Safety, Element (Noise and Safety Elements); e. The Circulation Element: f. The Public Services and Facilities Element. 5. The Planning Commission has, in response to its analysis of the testimony presentedJ, and pursuant to its deliberations, caused modifications to the 1994 Draft General Plan to be implemented. The Planning Commission is recommending the 1994 Draft General Plan, as amended, and the Environmental Impact Report and addendum related thereto, to the City Council of Diamond Bar for its approval and adoption. 7. All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution NOW, THEREFORE, it is found, determined and resolved by the Planning Commission of the City of Diamond Bar as follows: 1. The Planning Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. The Planning Commission hereby finds and determines that: a. The six components of the 1994 Draft General Plan completely address the mandatory elements, and the mandatory legal contents required therein, pursuant to California Government Code Section 65302 and all other applicable statutes; b. The 1994 Draft General Plan is informational, readable, and available to the public pursuant to California Government Code Section 65357; 2 c. The six components are internally consistent with California Government Code Section 65300.5. d. The 1994 Draft General Plan is consistent with the State of California policies, rules, regulations, and guidelines; e. The 1994 Draft General Plan covers all territory within the corporate boundaries of the City of Diamond Bar and further, incorporates all lands outside the corporate boundaries of the City of Diamond Bar which the Planning Commission has judged to bear a reasonable relationship to Diamond Bar's planning activities pursuant to California Government Code Section 65300; f. The 1994 Draft General Plan is long term in perspective pursuant to California Government Code Section 65300; g. The 1994 Draft General Plan reasonably addresses all local relevant issues and concerns currently identified. 3. The Planning Commission certifies that the Environmental Impact Report was completed in compliance with the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, the Planning Commission has reviewed and considered the information contained in said Environmental Impact Report and addendum and that said Environmental Impact Report and addendum reflects the independent judgment of the City of Diamond Bar and recommends that the City Council so find and certify. 4. The Planning Commission recommends that -the Council of the City of Diamond Bar approve and adopt the 1994 Draft General Plan, attached hereto as Exhibit "A", as the General Plan of the City of Diamond Bar. The Secretary of the Planning Commission shall: a. Certify to the adoption of this Resolution; and b.
