Dear Assembly Member McCarty:
The City of Diamond Bar strongly opposes Assembly Bill 1759, which would place significant
and undue burden on the City and its residential and businesses community.
Since incorporation in 1989, the City of Diamond Bar has worked diligently to meet all
applicable state and reginal housing requirements, including having a certified Housing
Element that includes zoning sites to meet Regional Housing Needs Assessment (RHNA)
targets. The task of meeting ever increasing housing requirements is complicated by the
fact that Diamond Bar is a built out community and does not own or develop property for
housing, and relies on the open market and private financing to meet housing needs.
AB 1759 would go much further than the intent of current law, and seeks to penalize
jurisdictions by withholding transportation funding from agencies unable to meet RHNA
numbers. This financial trigger of withholding transportation funding from cities not only
goes against the expressed provisions under SB1, but further impedes the ability for cities
to make wise capital investment decisions that will ultimately lead to more accessible
transportation and housing focused development projects.
For these reasons, the City of Diamond Bar strongly opposes AB 1759.
