Staff recommends that the Planning Commission approve Development Review No. 99-10, Findings of Fact, and conditions of approval as listed within the resolution. Kurt Nelson, Diamond Bar West, LLC, explained this pre -sold project. He asked that any color variations remain extremely subtle because this is a large house. AssocP/Lungu explained to C/McManus that staff is concerned about the monochromatic feel of the neighborhood and is seeking a subtle adjustment with respect to the proposed color. C/Ruzicka asked for further clarification with respect to color. DCM/DeStefano responded that staff is not suggesting a specific color. It is simply staff s observation that the colors of these products seem to be blending together from one house to another. This is not necessarily just a matter of color that tends to blend the appearances, it is the type and quantity of different materials, the architecture, the shade and shadow that occurs, the landscaping, the orientation of the unit on the lot, etc. There are many factors that can change the look and appearance of the unit. Kurt Nelson explained why he believes this custom built product will offer some differential to the look of the neighborhood. He does not favor going to a buyer who has purchased two lots and produced a Fung Shui product if he does not have to do so. DCM/DeStefano explained to Chair/Tye that staff has been concerned that this developer's homes have tended to look alike in color. It is staff's opinion that there needs to be more contrast from one house to another and it is not apparent in this product. Mr. Nelson responded to Chair/Tye that this tract is not a part of "The Country Estates" and that the tract has its own homeowners association that renders approval of projects in the tract. Chair/Tye opened the public hearing. There being no one who wished to speak on this item, Chair/Tye closed the public hearing. C/Ruzicka moved, C/McManus seconded, to approve Development Review No. 99-10. C/McManus asked that the motion be amended to strike Condition 5 (H) on page 6 of the resolution. C/Ruzicka accepted the amendment. Motion approved 4-0-1 by the following Roll. Staff recommends that the Planning Commission approve Development Review No. 99-1.1, Findings of Fact, and conditions of approval as listed within the resolution. Kurt Nelson, Diamond Bar West, LLC, explained that the project proposes a tum -in garage, which helps to tuck it away. In the tract, he rarely sees a home with more than four vehicles. He does not understand staff s comparison with "The Country Estates" vehicle parking requirement. He cannot promise how many vehicles a buyer is going to have but he does not anticipate that there would be more than five. The project provides for six or seven vehicles. He said he would prefer not to have to punch the house out in back for the sake of a garage space that is not needed which would reduce the size of the yard. In all other aspects, he concurs with staff s recommendations. C/Kuo asked for explanation of the side yard setback calculations which was provided by DSA/Smith. Chair/Tye opened the public hearing. There being no one who wished to speak on this item, Chair/Tye closed the public hearing. C/Ruzicka moved, C/McManus seconded, to approve Development Review No. 99-11. Following discussion, C/McManus requested that the motion be amended to modify Condition 5. (G) on Page 7 to indicate that the garage shall be redesigned as required per the Development Code, Section 22.30.070, Table 3-11. C/Ruzicka accepted the amendment. The environmental evaluation shows that the proposed project is Categorically Exempt pursuant to Section 15311(a) of the California Environmental Quality Act (CEQA). Generally, the following zones and uses surround the project site: to the north and south is Office Professional (OP), east is the Low Medium Residential (RLM), and west is State Road 57. ANALYSIS° Review Authority This application requires a Comprehensive Sign Program and Development Review per the City's Development Code. Pursuant to Section 22.36.060, a Comprehensive Sign Program is required whenever five or more signs are proposed for new or existing development. Therefore, the request for three wall signs, and three door signs for this single -tenant site initiates the Comprehensive Sign Program for this application. Section 22.48.020.B states that Administrative Development Review is required for projects involving a Building Permit for re -construction of a commercial structure. The proposed project changes the architectural style of the fagade, spire, and adds awnings; therefore, is subject to Administrative Development Review. Pursuant to Development Code Section 22.48.030, permits shall be acted upon concurrently and the highest authority shall make final determination. The Planning Commission is the highest authority. N The proposed sign standards meet the City's requirements utilizing 78.85 square feet of signage. The allowed signage for a single -tenant site is 125 square feet. 1. Wall Signs Red and white are corporate colors for Kentucky Fried Chicken (KFC). The two wall signs, "KFC", for the north and south side of the building, are self-contained channel letters of white acrylic with red 3M -film overlay and white detail. Each is 22.5 square feet. The sign faces have red trim cap. The front wall sign is a pictorial representation of Colonel Sanders (mug) with fluorescent illumination. The background for this sign is white scored stucco - like material. This sign faces Diamond Ear Boulevard and State Road 57. 2. Spire The spire is considered an architectural feature of the building. The colors of red and white are synonymous with KFC, as is the spire's red and white stripe. The current site has a mug and illuminated red and white spire. This application requests enlarging the spire and adding a flat wall background for this enlarged mug. The revised illuminated spire is approximately 49 square feet. An illuminated spire is found in surrounding cities and at the KFC at 2709 South Diamond Ear Boulevard. Staff visited sites that have incorporated the proposed design for the spire. One, on Arrow Highway near the Montclair Mall and another, at the comer of State College and Chapman in the City of Fullerton. The plans propose a 400 -watt metal Halide bulb used at these locations. It is staff's opinion, that in order to be considered an architectural feature, the illumination should be subtle to enhance, not draw attention as a sign as is the case with this design. Currently the spire is illuminated with fluorescent bulbs as is the spire on South Diamond Ear. Per the Development Code, no wall sign may project above the edge of the structure's roof. Therefore, the illumination of the spire will be revised to offer a wall -wash effect to be reviewed and approved by the Planning Division. 3. Awnings The awnings are also considered an architectural feature with the red and white stripe consistent with the spire. The fluorescent lighting at the back will wall -wash downward to light the sidewalks. The awning design has a white egg -crate diffuser at the bottom. Currently, the site has fluorescent tubes under the canopy, and this new design enhances the location. The Development Code does not allow illuminated awnings and the plans call for an opaque white awning with vinyl overlay. Staff has visited several KFC sites and all sites have similar awnings and are illuminated both outward and downward. Staff is recommending and the applicant has concurred that a black vinyl interior will be installed to eliminate outward illumination. It is a condition that the awnings have only downward illumination and the revised plans will be reviewed and approved by the Planning Division. 4. Monument Sign The existing monument sign is a pole -sign that was built and approved in 1974, prior to the effective date of the City of Diamond Ear Development Code. As a result, the monument sign is considered a legal non -conforming structure. The legal non -conforming sign's location, size, moving bucket, changeable copy, is permitted as it was previously approved. Furthermore, maintenance and repair of a legal non -conforming sign is permitted, should the t applicant choose to reface the sign. Per Development Code Section 22.36.090, Nonconforming Signs, the Director gives an amortization period of 15 years from the date of the first written notice to the owner of a non -conforming sign. A condition has been added that the beginning of the amortization period begins with this project's approval. Administrative Development Review Kentucky Fried Chicken has revised its corporate image. The application is a request to update the current signage and reconstruct the exterior structure to accommodate the signs f6r this new image. ® Development Standards The discretionary Administrative Development Review looks at the total site; however, the square footage, interior design and occupancy are not changed for this reconstruction. The following is a comparison between the City's development standards and the proposed project's development standards. The current red mansard roof will be replaced with new metal framing and a revised facade with blue and buff colors added to the typical red and white. The front scored stucco sto-wall is another added feature. The following materials and colors will be utilized: Exterior walls for fagade Sto®wall framing system: Bands of blue -VQ 7257, Buff -3630®149, Red VQ7255, White -chip to be submitted to the Planning Division for approval; Existing stone to remain; Existing building to be painted white to match Sto®wall. C-1 ® Landscape The current landscaping on site does not meet the minimum's set by the current Development Code; however the site was approved prior to the adoption of the current code. It is a condition of approval that the site replace missing groundcover in current planters and fill in areas where planting is missing. The applicant is required to submit landscape plans at a later date, reflecting the landscaping guidelines for the City's review and approval. ® Parking Lot Los Angeles County approved the parking lot and drive-through. The drive-through is considered legal non -conforming per the current Development Code. As with the pole sign, maintenance and repair of a legal non -conforming approval is permitted. The site plan , Attachment "A", reflects the current conditions approved in 1988 except for a yellow directional arrows near the drive-through. The Public Works Division concurs with the 1988 plan. It will be a condition of approval that the parking lot be striped according to the 1988 plan with the addition of a directional sign near space 18. Additionally, a condition has been added to update the parking lot to ADA requirements. Additional Review The Public Works Division and the Building and Safety Division reviewed this project. Their recommendations are a component of the draft resolution. The environmental evaluation shows that the proposed project is categorically exempt pursuant to the guidelines of the California Environmental Quality Act (CEQA) Section 15302(b). Pursuant to Chapter 22.36 of the Diamond Bar Development Code, a Comprehensive Sign Program does not require a public hearing or notification of property owners surrounding the project site. However, the Administrative Development Review requires a public hearing; therefore, this item has been advertised in the San Gabriel Valley Tribune and the Inland Malley Daily Bulletin newspapers on October 29, 1999. Seventy-four property owners within a 500 -foot radius of the project site were notified by mail on October 28, 1999. A notice of public hearing on a display board was posted at the site on October 19, 1999 and displayed for at least 10 days before the public hearing. Three other sites were posted within the vicinity of the application. Staff recommends that the Planning Commission approve Comprehensive Sign Program No. 99-7, Administrative Development Review No. 99-17, Findings of Fact and conditions of approval as listed within the attached resolution. 1.
