BACKGROUND / DISCUSSION: On December 2, 2014 the City Council considered its options and took action to commence a process to appoint an individual to fill the vacant seat. City staff advertised the vacancy and made application materials available to the public. Applicants will be interviewed by the City Council on January 5, 2015 at 3:00 PM within the Windmill Room of City Hall. The public meeting will be video taped for broadcast on DBTV Time Warner Channel 3 and Verizon Fios Channel 47. Twelve applications were received by the submittal deadline of 4:30 PM, December 19, 2014. One candidate subsequently withdrew his application. City staff communicated with the eleven remaining candidates to establish the following January 5, 2015 interview schedule: 1. Robert Nishimura 3:10 p.m. 2. Tulsi Savani 3:30 p.m. 3. Joyce C. David T. Liu 6:45 p.m. Following the interviews, the City Council may choose to select an individual to fill the vacancy. The City Council must select a new Council Member with a minimum of 3 votes to approve the candidate. The City Council must decide if the appointed person will serve the remainder of the former incumbent's term expiring in November 2017 or only until a special election is held concurrent with the scheduled statewide elections in June 2015 or November 2015. The City Council can proceed with these decisions in any order or concurrently. If the Council decides to vote for the new Council Member first, prior to deciding the length of the term, it is recommended that the appointment be contingent upon the new Council Member agreeing on the length of the term. If the City Council is unable to select a candidate from the eleven applicants listed, the Council may choose any process it deems appropriate to consider and select a new member. The City Council has until January 30, 2015 to appoint a new member or decide to hold a special election. FISCAL IMPACT: There is no fiscal impact associated with the consideration of this item. However, should the City Council choose to call an election to fill the seat vacated by former Council Member Chang, it is estimated that the City would incur election -related costs of approximately $150,000. BACKGROUND / DISCUSSION: With Council Member Chang's election to the California Assembly (Ms. Chang's Council seat is automatically vacated upon her swearing-in to the Assembly on December 1), there is now a vacant seat on the Diamond Bar City Council. Pursuant to Government Code Section 36512(b), the City Council must take action to fill the vacancy within 60 days (no later than January 30, 2015) by appointment or by calling a special election. The Diamond Bar City Council has faced this situation on five previous occasions, choosing to appoint a replacement four times while calling a special election once (in 2005). The City Council may choose from the following three options: 1. Appoint an Individual for the Remainder of the Term The City Council may choose to appoint an individual to the vacant seat for the remainder of the former incumbent's term expiring in November of 2017. The appointment will require a majority vote of Council Members present in a quorum. The appointed individual must be a United States citizen, registered voter, and a Diamond Bar resident eighteen (18) years of age or older. The City Council is under no legal obligation to advertise the vacancy, solicit applications or conduct interviews before appointing an individual to the empty seat and may choose any appointment process it deems appropriate. However, should the Council choose to appoint, staff recommends a uniform application and interview process be used to transparently choose the most qualified candidate. The use of the attached appointment application form is recommended. It should be noted that any City Council interviews would be subject to Brown Act requirements and a vote on the appointee must be made at a public meeting. To ensure all legal requirements related to an appointment are met, the following timeline is recommended: • Council Meeting of December 2, 2014 - City Council announces vacancy, intent to appoint and term of appointment (for remainder of unexpired term or until special election). Council directs staff to post a Notice of Council Vacancy and make application materials available to the public. • December 19, 2014 at 4:30pm - Deadline for candidate applications. • Week of January 5, 2015 - Council interviews with selected candidates followed by Council deliberation and discussion. • Special Meeting of the City Council held any time prior to January 30, 2015 — Vote on appointment followed by announcement of the appointee. 2. Appoint an Individual to Serve Only Until a Special Election is Held Per Diamond Bar Municipal Code Section 2.04.30, the City Council may appoint an individual to serve until the date of a special election called by the City Council. The appointed individual would be eligible to run for office in the special election. As per above, while it is recommended by staff, the City Council is under no obligation to solicit applications or conduct interviews and may appoint upon a majority vote of a quorum of the Council. 3. Call a Special Election If the Council chooses to call a special election, state law provides that it be held on the next regularly established election date not less than 114 days from the call of the special election. Given the January 30, 2015 deadline and 114 day window, the special election could be held on either June 2, 2015 or November 3, 2015, concurrent with the scheduled statewide elections. When calling the special election, the Council may leave the office vacant until the special election and operate as a four member body or appoint an interim Council Member whose seat would expire on the date of the special election. The victor in the special election would hold the office for the remainder of the term of the former incumbent, which expires in November 2017. Because the County of Los Angeles will not be holding an election in June 2015, the City will not be able to consolidate the special election with the County as it does with regularly scheduled November municipal elections. Thus, should the Council choose to hold a June 2015 special election, the City would be fully responsible for conducting the election, and would be required to secure all election -related materials and equipment, print and distribute ballot materials, review voter registration/eligibility, retain precinct workers, count votes, etc. These requirements will likely generate costs of approximately $150,000. If the Council chooses to hold a special election in June, these costs would come in addition to costs of the regularly scheduled November election. Through my community involvement I am in a unique position to interact with a whole cross-section of the community. Through the schools I am in constant contact with administrators, students, teachers, and parents. On my daily hikes in the city I meet new neighbors, mostly fellow retirees. My involvement with the Diamond Bar Girls Softball League keeps me in touch with parents, players, City officials, and leaders from neighboring communities and other youth sports leagues. Through my law enforcement activities I have contact with various community members, residents, crime victims, offenders, and other local law enforcement officers. I am in frequent contact with the deputy who patrols my reporting district. Finally, as a retiree I can commit the time needed to fulfill the obligations of being a member of the Diamond Bar City Council. 4. in your view, what is the role of the City Council and local government? The role of the City Council is to represent their constituents to develop policies for the greater good of the City. The City Council manages the budget and focuses on the community's goals, major projects and long- term considerations. The City Council directs the City Manager to implement these policies.. Through these policies the City is able to provide the infrastructure and programs for the City to successfully function. The City Council works in partnerships with other cities, local districts, committees, and various legislators to implement and advance common goals. 5. In your view; what are the three most critical issues facing the City of Diamond Bar today. TRAFFIC One of the most critical issues facing the City of Diamond Bar today is traffic. We are at the junction of three counties and two major freeways. Outlets for traffic to the south and east are limited. The City must continue working with other agencies to improve the traffic flow on the 57/60 freeway interchange and the Grand Avenue interchange. Alternatives and improvements, such as traffic light synchronization, should ROBERT NISHIMURA-CITY COUNCIL VACANCY APPLICATION be sought to improve traffic flow on Grand Avenue, Golden Springs, and Diamond Bar Boulevard. Currently commuter transit is limited to bus service and the Metrolink rail station in the City of Industry. Nearby cities in the Northern portion of San Gabriel Valley will soon have light rail service via the Gold Line. The City should facilitate partnerships with our neighbors in Orange (OCTA) and San Bernardino (SANBAG) Counties to develop a regional transit platform similar to the Gold Line. FISCAL RESPONSIBILITY The City Council must ensure that policies are enacted to maintain good fiscal standing for the city. Revenues and expenditures must be managed so that the city can live within its budget and provide the maximum service possible to it's citizens. One example of managing revenues includes maintaining and expanding community and economic development. The city is losing revenue on the now vacant K -mart, the old Honda dealership, Burger King, and other vacant commercial properties. The city -must work to retain existing businesses and attract new business to the vacant properties. An example of managing expenditures would be to ensure that a sound plan is in place to ensure that future obligations can be met. The maintenance of our infrastructure must be funded and we need to ensure that our pension obligations are funded. MAINTAINING COMMUNITY IDENTITY The City Council must consider maintaining our positive image and identity as a community when policies are made. Things that reinforce our community identity are good recreation facilities, good schools, commercial districts and residential neighborhoods. We have good parks and trails. However Diamond Bar does not have a gym or aquatics facilities. The City is known for having excellent schools. We must continue working with our school districts to maintaining our highly rated schools. We must work to upgrade our commercial properties so that businesses and shoppers are attracted to shopping in Diamond Bar. I also believe that it is the duty of the local governmentto constantly look for ways to grow the community in terms of programs that serve the current demographic, which includes keeping up to date with technology, making efforts to stimulate economic growth for future stability and being mindful of public health and safety issues to give the citizens comfort and assurance that everything is being done to keep the city healthy and safe. Currently, I feel that three critical issues facing the City of Diamond Bar at this time include traffic, economic growth and a the city's lack of personality or identity. Being a freeway hub, the city of Diamond Bar is constantly inundated with commuter traffic, especially during rush hour times in the morning and evening, in which it becomes very challenging for the residents to travel from, for instance, the south end of town to the north end. Frequent congestion of Diamond Bar Boulevard often results in late pick-ups for children at school or attending their various activities, such as martial arts or dance classes. Being a mostly residential town, retail options are limited in Diamond Bar, and many of its residents travel to neighboring cities such as Chino Hills, Walnut and Brea for options in shopping, dining and entertainment. Multiple fellow residents have shared this sentiment with me, and I feel that it is the consensus that most people would like to see more retail development in our city, and that they would be happy to support local businesses whenever they can. Lastly, one thing I have often felt and have encountered other residents who share the same sentiment, is that Diamond Bar lacks a unique sense of self or personality. Other neighboring cities have a certain personality such as Chino Hills being known for its beautiful parks and shopping, and Rowland Heights for its Asian delicacies. Being a largely residential city, Diamond Bar has pockets of interesting areas such as the newer Super H -Mart shopping center, which draws many of its residents to the restaurants. However, the residents of the city groan aboutthe run-down shopping centers lacking well-known shops and interesting hang- outs. It has become a place where you sleep, where your kids attend tae kwon do classes, but not a place where you necessarily do your day-to-day errands and seek entertainment. My hope for the future of Diamond Bar is to help it be a place notjust where people want to live so that they can attend great schools. My hope is for it to be a.great place, where people continue to bring their families and enjoy the safety, the diversity and the educational Prowess, but also, to really just enjoy living within its borders... period. I have been involved in business and management of hospital affairs for a number of years. I have been a part and parcel of various medical missions to Mexico and other countries. All matters that an incorporated city, like Diamond Bar, that need to be addressed are decided by the City Council and Mayors. It is important for the Council to hear the concerns of the residents and businesses alike to provide solutions and resolutions for specific issues. The Local Government, in its entirety develop and propose legislature for the city that are analyzed and reviewed by the Council to be voted on then passed. I believe that the local government, while satisfying the concerns of residents and business owners, must address the issue of growth. This growth can be explained as a three - pronged solution to achieving any city, district, or state success. The first being that of economic growth. A City relies on the revenue local business generate, and it is important to not only support local business, but to expand and commercialize the city to an extent to elevate the city's business profits. After attending the most recent City Council Meetings, I feel like a major issue that needs to be addressed is "The Country Estate" and its position within the city of Diamond Bar. The internal board of the community displays weaknesses. Issues that cannot be addressed within this private community will ultimately be brought upon as a fault of the Diamond Bar Government, using it as its scapegoat to resident dissatisfaction. But this is not the most critical issue. A lack of vision is a critical issue of Diamond Bar. I feel that a vision to develop Diamond Bar into a thriving socio-economic city is extremely critical to the future of the city. Neighboring cities like Walnut and Chino Hills have Shopping centers that attract lots of consumers. Diamond Bar needs to revive its image with a timeline planned to develop a downtown that resonates the history of Diamond Bar, but at the same time attract consumers to ensure the financial success of new and existing businesses. This, if executed properly, will boost property value of Diamond Bar real estate. The evolving landscape and commercialization of cities is what ensures its long term success. Diamond Bar, being a fairly young city needs to adapt to the new business climate and continue to grow. Also, I believe that we need to encourage and empower students in Diamond Bar to continue to pursue higher education. I believe a lot of tax fund on entertainment and recreation, as well as certain sectors of retailing from Diamond bar residents are spent outside of the City limit. i am no exception because certain quality goods are not available within the city. I joined Bucher, Willis & Ratliff Partnership in Kansas City, Missouri in April 1973, immediately after receiving my master's degree from Kansas State University, as a design engineer. I was admitted to the BWR partnership in 1983 and was designated as the Partner -in -Charge of all traffic engineering projects throughout the firm. In 1995, the partnership was restructured to become a corporation and I was appointed the president of Bucher, Willis & Ratliff Corporation, which had grown to 16 offices throughout the country. From 1997 to 2002, 1 served as the Chairman of the firm, directing the policy and management decision of the firm until my retirement from the firm. In 1990, 1 was recruited by the United Nations, under the UNDP, as one of the Expatriate transportation experts assisting china in their transportation development. Also in 1990, BWR in association with Comsis Corporation of Silver Springs, Maryland, created a joint venture of "Chinese American Technology Corporation (CTC)," providing international design and planning consulting services in Taiwan. I was appointed as the president and CEO of CTC from its inception. BWR later acquired all of Comsis' interest in CTC and the firm has become a subsidiary of BWR. I was also in charge of all other international business activities for the firm. Since 1991, BWR has actively and successfully pursued Transportation business in China with projects financed through the World Bank Organization. Since 1991, Mr. Lin had made over 90 trips to both China and Taiwan, respectively and played a substantial role in both nations in their transportation infrastructure development. Between March, 1985 and March 1993, 1 was elected and served as a four -term Council member for the City of Leawood, Kansas, a suburb of Kansas City, Missouri, representing the largest Ward (No. 4). 1 was instrumental in the construction of a new municipal Iron Horse golf course, a new City Hall, a new upscale regional shopping center, and the improvement of one of the most congested arterial streets in the Kansas City region. I am currently involved in the National Unification Advisory Council (NUAC), a nonprofit organization under the Korean National Government as the Chairwoman of International Affairs. The city government makes decisions on the behalf of the citizens for building projects, finance, public works, maintenance, traffic concerns, community activities, tourism, education, and safety. S. In your view, what are the three most critical issues facing the City of Diamond Bar today. I believe the three most critical issues facing Diamond Bar are listed below: A. Business Loss: There are many businesses that are leaving this city. Once highly trafficked plazas with flourishing businesses such as Ralphs and K -Mart have been forced to close down for various reasons. Therefore, rental spaces that are integral parts of the city's economy lay empty. Each day that these spaces are unused leaves a negative impact on the city terms of revenue loss and potential jobs that could be given to the residents. B. Lack of Employment Opportunities: The City of Diamond bar does not have sufficient employment opportunities for the residents to work in and provide for their families. As mentioned earlier, businesses leaving the Diamond Bar are detrimental to the city. As the business leaves, so do the jobs. Specifically, many recently graduated college students come back to Diamond Bar to live with their parents and have a difficult time finding employment close to home due the insufficient employment resources provided to them. C. The Millennium Diamond Road Partner Development: In 2006, the Diamond Bar City Council approved a residential community development project that would create 48 new homes for future residents. Fast forward to now, there are many items that still need to be reviewed such as the geotechnical survey, zoning issues, sewer lines, permits, etc. After all of these factors are discussed and studied, then the council will be able to move forward to approve and start construction. I believe that this development will be advantageous for the city of Diamond B ar. It will provide new homes for residents to live and enjoy the city's various amenities, such as Diamond Bar's world-class educational system. Furthermore, these new residents will be able to contribute to the city with their resources and taxes. III K.
