3. DISCUSSION OF ENVIRONMENTAL IMPACT REPORT SUBMITTED BY THE
CITY OF INDUSTRY FOR THE PROPOSED INDUSTRY EAST PROJECT —
The Industry East Development Project, as currently proposed by the developer,
Industry Land LLC, is a 425 -acre industrial project, consisting of approximately
6,600,000 million sq_ ft. of primarily industrial uses. The site is generally located
adjacent to the City of Diamond Bar. The project proposes the development of
31 buildings ranging in size from 3,500 to 870,000 sq. ft. in size. Approximately
49% of the project is designed to be served by rail. Access to the project is
proposed from Washington St., Brea Canyon Rd and Grand Ave. Significant
new public roadways and infrastructure will be necessary to support the
proposed industrial parr.
Recommended Action: It is recommended that the City Council direct staff as
necessary regarding a response to Industry East Project Draft Environmental
Impact Report.

The City Council has scheduled a Special Meeting for 6:30 PM, Tuesday May 30, 2000 to
discuss the City of Industry prepared Draft Environmental Impact Report for the proposed
Industry East Development Project.
Recommendation:
It is recommended that the City Council receive,a presentation from the City staff and
consultant, receive public comment and direct staff as necessary; regarding a response to the
Industry East Development Project Draft Environmental Impact Report.
Background:
The City of Industry, in accordance with the California Environmental Quality Act (CEQA) has
prepared a Draft Environmental Impact Report to inform decision makers of the direct, indirect
and cumulative impacts of the proposed 425 acre Industry East Development Project to be
located adjacent to the City of Diamond Bar.
Presented herein are the preliminary findings of the 'Community and Development Services
Department (Department) concerning the potential impacts upon Diamond Bar (City or Diamond
Bar) resulting from the implementation of the proposed Industry East project, located in the City
of, Industry (Industry or Lead Agency) and described in the "Draft Industry East Environmental
Impact Report" (DEIR). The Information presented herein is intended' to provide the City
Council with a"brief overview of that project and a summary of certain relevant information as
presented by the Lead Agency. Since no independent studies have been initiated by the City to
validate or refute the statements presented in the DEIR, this summary merely reports upon the
information presented and makes no representation concerning the accuracy or adequacy with
which the project and the resulting impacts are described.
Based on the Department's cursory review of the DEIR there Is reason to believe that the
project's ,actual impacts may exceed those represented by the Lead Agency. Similarly, based
on a review of the recommended mitigation measures, in many instances, there is no supporting
evidence demonstrating that the proposed measures will have their desired effect. As a result,
notwithstanding declarations to the contrary in the DEIR, both the actual and post -mitigated
impacts of the `project may be substantially greater than now disclosed by the Lead Agency.
This report is divided into the following five sections: (1) California Environmental Quality Act;
(2) Project Description; (3) Environmental Impacts; (4) City of Diamond Bar General Plan; and
(5) Recommendations.
1.0 California Environmental Quality Act
The California Environmental Quality Act (CEQA) establishes`,the requirements for and statutory
basis upon with the DEIR has been prepared. In accordance therewith, public agencies are
required to prepare an environmental impact report (EIR) for those activities, subject to CEQA,
that have the potential to produce a direct, indirect, or cumulative impact upon the environment.
The release of an EIR commences a 45 -day review period during which public agencies and the
general public can submit comments to the Lead Agency for consideration in the agency's
deliberations concerning the proposed project. Written responses`, from the Lead Agency are
required for any comments submitted during that public review period. Although late comments
can be provided, the Lead Agency has no obligation to prepare writtenresponses to those
comments. The 45 -day comment period established for the DEIR commenced on April 20,
2000 and concludes on June 5, 2000.
Written comments provide an opportunity to seek clarification regarding information presented
and request further analysis on those issues that may need further explanation. Additionally,
should a legal challenge be raised'' asserting an agency's failure to fully ,comply with its CEQA
obligation, the resulting challenge may be limited to only those issues that have been previously
raised in comments submitted on the EIR.
2.0 Project Description
In July 1999, the Industry Urban - Development Agency (IVDA) executed a "Disposition and
Development Agreement" (DDA) with Industry East Land, LLC (Majestic Realty) authorizing the
construction of 6,638,300 square feet of mixed industrial and commercial development on a
425 -acre spanning both sides of Grand Avenue and generally described as bordered on the
north by Valley Boulevard, on the west by Brea Canyon Road and on the south ,by the SR-
57/SR-60 Freeways. As described in the DEIR, the project would include: (1) 4,335,000 square
feet of warehouse use; (2) 2,041,800 square feet of industrial use; and (3) 250,000 square feet'
of commercial use. An extensive rail network will be provided internal- to the project site;
providing direct rail access to an estimated 3,252,800 square feet (49 percent) of industrial and
warehouse facilities,
The entire site will be mass graded over a period of 12 to 18 months, commencing in June
2000. All infrastructure required to support on-site land uses would be constructed in a single
phase over a 25 -month period, also commencing in June 2000.
These uses would be contained in 31 separate buildings, ranging in size from 3,500 square feet
to 870,000 square feet. For the purposed of comparison, the two buildings that comprise the
recently constructed Wohl Group Industrial Project (located west of Grand Avenue) are 274;474
square feet and 318,497 square feet (totaling 592,971 square feet). Additionally, the ten
buildings that comprise The Plantation collectively total 1,547,687 square feet. The proposed

project is, therefore, more -than three -times larger, that the square footage within the Wohl and
The Plantation sites combined.
A number of new roadways will be constructed to provide vehicular and truck access to the
project site, including a new street (Street "A") that extends' from Grand Avenue to Washington
Street. With the project's construction, existing traffic volumes on Washington Street would
increase from 3,045 average daily trips (ADT) to 16,298 ADT by the Year 2020.
Since the Lead Agency asserts than no specific uses have yet to be defined, the DEIR neither
commits the Lead Agency to any specific siting of on-site land uses, specific rail improvement
plan, or limitations on the type and/or operational characteristics of those uses that may be
developed on the project site over a projected 10 -year construction period. Although' not
defined to any reasonable level of detail, the DEIR identifies an "initial occupancy phase"
located near the intersection of Valley Boulevard and Brea Canyon Road. That single, rail
accessible 775,000 square foot building is scheduled to commence construction in August
2000.
3.0 Environmental Impacts
Although the DEER addresses a broad array of issues; the two topical areas of potentially the
greatest concern to Diamond Bar relate to land use compatibility and traffic impacts. The
following comments are, therefore, limited to those two issues. The City's review of the DEIR is
continuing and, if so directed, a comprehensive response thereupon can be provided to the
Lead Agency within the specified comment period.
Land Use
■ The nearest industrial building to existing residential units in Diamond Bar, which are
located off of Washington 'Street, is indicated to be approximately 60 feet. Outdoor
activities (e.g.,' material and equipment storage, loading and unloading) associated with
those uses could be conducted up to the edge of the property line.
Rail improvements will be constructed along the existing UPRR line and will support
undisclosed industrial activities conducted in a 409,500 square foot facility to be
developed directly adjacent to Alder Lane. The separation distance between proposed
rail facilities and adjoining residential receptors is not disclosed in the DEIR but could
potentially occur up to the property limits.
■` Since no performance standards are specified for any future industrial use, (i.e. noise,
odor, vibration) the precise nature of any impacts generated by those uses cannot be
ascertained at this time. It is, however, evident that hazardous, flammable, corrosive,
and explosive materials will be transported, stored, and/or processed on the project site.
Similarly, all authorized land uses could operate 24 -hours per day.
Traffic and Circulation
■ Intersection improvements are identified in the DEIR which are intended to mitigate for
additional traffic and which produce a Level of Service (LOS) "D" or better, operations,
which is defined in the DEIR as the maximum "acceptable" level. Some of the
improvements with Diamond Bar include extensive road widening, freeway bridge
improvements, acquisition of additional right-of-way, displacement of existing

businesses, loss of existing parking, and reduction in private property (including the
corresponding uses thereupon) along affected street frontages:

Figure 1 and Figure 2, prepared for the Department by WPA Traffic Engineering,
provides separatesketches of existing and ultimate Fane geometries at those
intersections located in Diamond Bar that the DEIR indicates will be impacted. The
sketches illustrate the number of approach lanes that need to be added and are
intended to provide an overview of the needed traffic improvements in the City.
■ In spite of the identification of these improvements, the DEIR concludes that traffic
impacts outside Industry will remain "cumulatively significant after mitigation" due to the
uncertainty concerning whether or how these improvements are to be undertaken, if
undertaken at all.
■ Specific improvements to the affected intersections in Diamond Bar are not presented.
The DEIR appears to suggest that a "fair share" could be provided by the Lead Agency
toward the cost of each improvement, however, no firm commitment tothe payment of
that contribution exists therein, no detailed plans are presented, no performance
schedule for implementation is provided, and no estimated improvement costs or "fair
share" contribution disclosed. The DEIR indicates that there is an "uncertainty" whether
these improvements will be built in the future and the document is structured to allow the
'Lead Agency to adopt a "Statement of Overriding Considerations" accepting the
deterioration of local traffic conditions as an acceptable consequence of the project.
■ Detailed design concepts or cost estimates are not included in the DEIR so it is not
possible to determine the amount of any "fair -share" contributions that would be required
from the proposed project. Only generalized statements are provided concerning the
manner in which traffic improvements in Diamond Bar could occur and the impacts to
adjoining land uses that might result therefrom. As indicated in the DEIR, although the
Lead Agency suggests that certain improvements could potentially be accommodated
merely through re -striping of existing lanes, those declared' impacts include``
Grand Avenue at SR -60 Eastbound Ramp. Widening of the freeway bridge,
demolition of 6,000 square feet of existing commercial use, and modification to
the golf course and its existing access, including extensive slope stabilization and
removal of existing mature trees.
♦ Grand Avenue at SR -60 Westbound Ramp. Widening of the freeway bridge,
loss of an estimated 15 feet of lot frontage, parking, and landscaping affecting
the automobile dealership and fast-food restaurant. Although not disclosed in the
DEIR, the affected area within the automobile dealership represents a large
portion of that property now used for display and customer parking.
♦ Grand Avenue at Golden Springs Road. An estimated 40 -foot widening along
Grand Avenue and 60 -foot widening along Golden Springs Road, resulting in the
removal of the service station, preschool, and portions of the church and golf
course parking lots. The DEIR' identifies the need to demolish an estimated
15,000 square feet of commercial uses and presents no definitive plans to
replace any lost parking.
Grand Avenue at Diamond Bar Boulevard: Widening by approximately 10
feet in the northbound direction, by approximately 20 feet in the southbound

direction, and approximately 10 feet in both the eastbound and westbound
directions, resulting in encroachment onto adjoining properties (e.g., banks,
market, restaurant, automobile service garage, coffee shop, and other retail
shops). These improvements would potential result in the displacement of two
banks through loss of their drive-through tellers.
♦ Brea Canyon Road at Lycoming Street. Undisclosed impacts upon existing
service station, daycare center, office building, automobile body and painting
facility, and residential land uses associated with the widening of Brea Canyon
Road by approximately 10 feet. Since the DEIR concludes for significance, the
displacement of the daycare center and certain residentialunits is assumed.
♦ Brea Canyon Road at SR -60 Westbound Ramp. Undisclosed impacts upon
existing residential and commercial uses, and recreational vehicle storage. yard
associated with the widening of the roadway by approximately eight feet:
Brea Canyon Road at Golden Springs Road. Widening would remove or
severely encroach upon a sit-down restaurant, fast-food restaurant, and service
station, including the potential loss of all or some of those land uses.
SR -60 Eastbound Ramp at Golden Springs Road. Additional right-of-way
would involve undisclosed impacts to some commercial uses (e.g., fast-food
restaurant and retail shops), including the potential removal of those -existing
uses.
♦ Brea Canyon Road at Washington Street. Undisclosed impacts to existing
residential and commercial/industrial uses associated with the widening of Brea
Canyon Road by approximately six feet along each side of Brea Canyon Road.
♦ Brea Canyon Road at Pathfinder Road. Undisclosed impacts,upon parking,
driveways, landscaping, medians, and sidewalks but no building removal is
indicated in the DEIR as a result of the unspecified right-of-way widening.
■ Based on the lack of specificity regarding those street improvements in Diamond Bar, a
substantial effort would still be required to determine the 'precise nature of those
improvements. Since extensive right-of-way will be needed and since a full or partial
taking will be required for a number of adjoining land uses, real property appraisals
would be necessary to determine the actual costs for mitigation.
■ Table 25 from the DEIR traffic study (attached) provides the Lead Agency's preliminary
calculation of the project's percentage share of the required mitigation costs. The
improvements are indicated to be extensive and the associated costs are expected to
total tens of millions of dollars. Since only a "fair share" issuggested, the DEIR appears
to indicate that "others°' (e.g., City of Diamond Bar) will be required to contribute the
remaining funds in 'order for the improvements to be constructed.
■ The proposed project results in potentially significant mitigation "burdens" being imposed
on "other" agencies and on future projects within the City. '-Because of the anticipated
high costs associated with mitigation, the need for eminent domain action to acquire
additional right-of-way, and the obligation to pay relocation expenses to affected
property owners and tenants, it may be difficult for Diamond Bar to finance the cost of
the recommended street improvements. Future projects in Diamond Bar would be

-required to bear a disproportionate share of the mitigation costs. For some future
Diamond Bar projects, these mitigation costs could render those projects infeasible.
■ Since insufficient analysis is provided to determine the actual impacts associated with
identified street improvements in Diamond Bar, further CEQA documentation (e.g.,
supplemental EIR) would be required by the City in order to initiate those improvements,
further increasing the cost and delaying the time for commencement of those actions.
■ Given the extent of the' improvements identified in the DEIR and the potential need to
reclassify a number of arterial highways in the City, it is possible that an update of the
"City of Diamond Bar General Plan" (Circulation Element) could be required in order to
implement the proposed improvements and ensure consistent.
■ It is reasonable to assume that the proposed project will continue and obtain local
approval independent of any actions by the City or independent of the initiation of any
traffic improvements in Diamond Bar, either now or in the future.
4.0 City of Diamond Bar General Plan
The "City of Diamond Bar General Plan (DBGP) identifies Washington Street as a "local
residential" street. As indicated therein, "local residential streets are designed to serve adjacent
residential land uses only.. .they are not intended to serve through traffic traveling from one
street to another." As further indicated in the DBGP, it is the declaredpolicy of the City to
"maintain the cul-de-sacs of Sunset Crossing Road,' Beaverhead Drive, Washington Street and
Lycoming Street at the City's boundaries."
As proposed, Street "A" is planned to extend from Grand Avenue to Washington Street,
providing a direct linkage between Brea Canyon Road and Grand Avenue. Since those
improvements would convert Washington Street to a "collector" road servicing industrial areas in
Industry, a general plan amendment (GPA) -would be 'required in order to implement the
improvements identified in the DEIR.
5.0 Recommendations
From the information presented in the DEIR, it is evident that the Lead Agency plans to certify
the EIR'and approve the proposed project within an expedited time frame and notwithstanding
any technical defects that may exist within the project's CEQA documentation. Since the City
lacks any land use authority thereupon, independent of the City's role under CEQA concerning
those traffic mitigation measures that has been identified in Diamond Bar, commencement of
construction can be anticipated in the near term.
Since no firm commitments are specified in the DEIR concerning' the Lead Agency's
determination of the precise nature, cost, or timing of those mitigation measures, the project will,
in all likelihood, proceed without that commitment and without reasonable assurance that the
identified measures will be performed.
The Lead Agency has not made any reasonable efforts to include Diamond Bar in the planning
process and did not meet with City staff to provide an overview of the proposed traffic mitigation
measures prior to the, release of the DEIR.
Project implementation will require extensive actions on the part of the City if the community
seeks to maintain an "acceptable" level of service along affected roadways. Those actions

would :necessitate major fiscal allocations over a number of years and would require
commencement of condemnation actions affecting numerous areas and existing land uses.
Although the extent of impacts are not known, implementation would result in the loss of
numerous businesses and create additional hardships upon those properties in which only a
partial taking would be required. Certain uses (e.g., automobile dealership) may not be able to
continue operation with the reduction in existing property and the accompanying need for the
reconfiguration of existing uses.
Individuals -and families residing along Washington Street would be significantly and
permanently impacted through the introduction of adjoining industrial uses and the activities that
are conducted thereupon, through the introduction of proximal rail activities, and through direct
exposure to substantial increases in existing traffic volumes, noise, and air pollutants. The
extension of Washington Street onto the project site would increase traffic, alter the existing
traffic mix, and result in an increase in travel speeds along that roadway; affecting the safety
and serenity of those residents who now take access from that roadway.
In recognition of these impacts, the City Council approved the following staff recommendations
at the May 22, 2000 Study Session:
■ Authorize the City Manager to submit written comments on the DEIR to the Lead Agency
within the specified comment period, including recommendations concerning possible
changes to the proposed .project to reduce or eliminate impacts upon Diamond Bar, its
residents, and businesses;
Authorize the City Manager to work with legal counsel to formulate written comments on
the DEIR in order to ensure compliance with CEQA and to retain future options and
opportunities for the City;
■ Authorize the City Manager to commence a constructive dialogue with representatives of
Industry to mitigate the potential impacts associated with the proposed project;
Encourage community residents to submit written comments to Industry prior to the
close of the comment period on June 5, 2000; and
■ Return to the Council at an appropriate future date with an update concerning the status
of the Industry East project.
In addition the City Council scheduled a Special Meeting for May 30, 2000 to provide
information and gain community input on the 'environmental issues associated with the
proposed project. -

The City of Diamond Bar will conduct a City Council Meeting at on Tuesday, May 30 2000, at 6:30 PM to provide
information and gain community input on environmental issues relating to the proposed City of Industry —Industry
East Development Project. The meeting, hosted by the Diamond Bar City Council, will be held at heritage Park
Community Center, located at 2900 South Brea Canyon Road.
The Industry East Development Project, as currently proposed by the developer, Industry Land LLC, is a 425 -acre
industrial project, consisting of approximately 6,600,000 million square feet of primarily industrial uses. The site is
generally located adjacent to the City of DiamondBar (see site plan on back). The project proposes the development
of 31 °buildings ranging in size from 3,500 to 870,000 square feet in size. Approximately 49 percent of the project is
designed to be served by rail. Access to the project is proposed from Washington Street, Brea Canyon Road and
Grand Avenue. Significant new public roadways and infrastructure will be necessary to support the proposed industrial
park
