PUBLIC INPUT The meetings of the Diamond Bar City Council are open to the public. A member of the public may address the Council on the subject of one or more agenda items and/or other items of which are within the subject matter jurisdiction of the Diamond Bar City Council. A request to address the Council should be submitted in writing to the City Clerk. As a general rule the opportunity for public comments will take place at the discretion of the Chair. However, in order to facilitate the meeting, persons who are interested parties for an item may be requested to give their presentation at the time the item is called on the calendar. The Chair may limit the public input on any item or the total amount of time allocated for public testimony based on the number of people requesting to speak and the business of the Council. Individuals are requested to refrain from personal attacks toward Council Members or other persons. Comments which are not conducive to a positive business meeting environment are viewed as attacks against the entire City Council and will not be tolerated. If not complied with, you will forfeit your remaining time as ordered by the Chair. Your cooperation is greatly appreciated. In accordance with Government Code Section 54954.3(a) the Chair may from time to time dispense with public comment on items previously considered by the Council. (Does not apply to Committee meetings) In accordance with State Law (Brown Act), all matters to be acted on by the City Council must be posted at least 72 hours prior to the Council meeting. In cases of emergency or when a subject matter arises subsequent to the posting of the agenda, upon making certain findings, the Council may act on an Rem that is not on the posted agenda. CONDUCT IN THE CITY COUNCIL CHAMBERS The Chair shall order removed from the Council Chambers any person who commits the following acts in respect to a regular or special meeting of the Diamond Bar City Council. A. Disorderly behavior toward the Council or any member of the thereof, tending to interrupt the due and orderly course of said meeting. B. A breach of the peace, boisterous conduct or violent disturbance, tending to interrupt the due and orderly course of said meeting. C. Disobedience of any lawful order of the Chair, which shall include an order to be seated or to refrain from addressing the Board; and D. Any other unlawful interference with the due and orderly conduct of said meeting. INFORMATION RELATING TO AGENDAS AND ACTIONS OF THE COUNCIL Agendas for the regular Diamond Bar City Council meetings are prepared by the City Clerk and are available 72 hours prior to the meeting. Agendas are available electronically and may be accessed by a personal computer through a phone modem. Every meeting of the City Council is recorded on cassette tapes and duplicate tapes are available for a nominal charge. ADA REQUIREMENTS A cordless microphone is available for those persons with mobility impairments who cannot access the public speaking area. Sign language interpreter services are also available by giving notice at least three business days in advance of the meeting. Requested by: City Manager 6.3 NOTICE OF COMPLETION FOR SUNSET CROSSING ROAD STREET REHABILITATION PROJECT FROM SR -57 OFF -RAMP TO GOLDEN SPRINGS DRIVE - The City Council, on July 16, 1996, awarded a contract to J.E.G. Construction, Inc., in the amount of $463,439. for Sunset Crossing Rd. Street Rehabilitation Project from SR -57 off -ramp to Golden Spgs. Dr. The final construction contract amount was $438,896.52. The final job walk was conducted on November 27, 1996 to determine the adequacy of all constructed improvements. Recommended Action: It is recommended that the City Council accept the work performed by J.E.G. Construction, Inc., and authorize the City Clerk to file the Notice of Completion and release any retention amounts per previously approved plans and specifica- tions. Requested by: City Engineer 6.4 RESOLUTION NO.97-XX: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR INSTALLING 20 FEET OF RED CURB ON EACH SIDE OF THE DRIVE APPROACH AND 210 FEET OF RED CURB IN THE PARKING LOT AT PAUL C. GROW PARK - The Traffic and Transportation Commission has recommended the installation of 20 ft. of red curb on each side of the drive approach to Paul C. Grow Park. The Parks and Recreation Commission has recommended 210 ft. of red curb behind the existing parking stalls and adjacent to the driveway in the parking lot at Paul C. Grow Park. The intent of these recommendations is to enhance visibility distance for motorists entering/exiting the park. Recommended Action: It is recommended that the City Council adopt Resolution No.97-XX installing 20 ft. of red curb on each side of the drive approach and 210 ft. of red curb in the parking lot at Paul C. Grow Park. Requested by: City Engineer 6.5 RESOLUTION NO.97-XX: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR RE -INSTALLING "NO STOPPING ANYTIME" SIGNS ON THE EAST SIDE OF BREA CANYON ROAD BETWEEN PATHFINDER ROAD AND PLAZA DIAMOND BAR'S SOUTHERLY DRIVEWAY - The Traffic and Transportation Commission has recommended the re -installation of the missing "No Stopping Anytime" signs on the east side of Brea Canyon Rd. between Pathfinder Rd. and Plaza Diamond Bar's southerly driveway. These signs were originally installed by the County in 1975. This JANUARY 7, 1997 7. PAGE 3 recommendation is based on the need to eliminate visibility restriction for motorists exiting from the driveway in discussion. Recommended Action: It is recommended that the City Council adopt Resolution No.97-XX re -installing "No Stopping Anytime" signs on the east side of Brea Canyon Rd. between Pathfinder Rd. and Plaza Diamond Bar's southerly driveway. Requested by: City Engineer 6.6 DIAMOND BAR BOULEVARD UNDERGROUND UTILITY DISTRICT NO. 2 - As part of the Diamond Bar Blvd. Underground Utility District No. 2 project, one hundred sixteen (116) additional street lights were installed on Diamond Bar Blvd. between Gold Rush Dr. and Temple Ave. The cost of installation is $131,000. The City has allocated $95,000 of Gas Tax monies from FY 96-97 budget. The remaining $36,000 is to be funded by Prop. C and Gas Tax funds. Staff requests the City Council approve $28,000 in Prop. C and $7,400 in Gas Tax funds towards the undergrounding project. Recommended Action: It is recommended that the City Council approve an additional $7,400 in Gas Tax funding and $28,600 in Prop. C funding for the Diamond Bar Blvd. Undgerground Utility District No. 2. Requested by: City Engineer PUBLIC HEARING: 7.1 RESOLUTION NO. 97 -XX: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR AMENDING CERTAIN CONDITIONS OF APPROVAL FOR VESTING TENTATIVE TRACT MAPS 47850, 47851 AND 48487 - The applicant for previously approved Vesting Tentative Tract Maps 47850, 47851 and 48487 has asked for a waiver of the condition related to requiring the installation of a reclaimed water system. Continued from December 19, 1996. Recommended Action: It is recommended that the City Council open the public hearing, receive testimony and adopt Resolution No.97-XX to delete condition No. 50 of Resolution No.95-24, Exhibit C, relating to Vesting Tentative Tract Map No. 47850; Condition No. 49 of Resolution No. 92-33 relative to Vesting Tentative Tract Map No. 47851; and Condition No. 49 of Resolution No.92-34 relative to Vesting Tentative Tract Map No. 48487. These conditions require the subdivider to install main and service lines for delivering reclaimed water. The Final Tract Map has been submitted by Diamond Bar Associates to the City of Diamond Bar for approval. Recommended Action: It is recommended that the City Council (1) approve the Final Tract Map No. 47850; (2) authorize the Mayor to execute the Subdivision Agreement; (3) adopt Resolution No.97-XX; (4) authorize the City Engineer to sign the map and (5) direct the City Clerk to certify and process the map and C.C. & R's for recordation. Requested by: City Engineer 8.2 PRESENTATION BY KAHLIL BENDIB - Mr. Bendib, a local sculptor, wishes to offer a sculpture of a mountain lion to the City of Diamond Bar. Mr. Bendib purposes to have the mountain lion sculpture placed in Summit Ridge Park. Recommended Action: It is recommended that the City Council consider the offer of the sculpture and direct staff accordingly. RECOMMENDATION: It is recommended that the City Council accept the work performed by J.E.G. Construction, Inc., and authorize the City Clerk to file the proper Notice of Completion and release any retention amounts per previously approved plans and specifications. FINANCIAL SUMMARY: This process of filing Notice of Completion has no financial impact on the City's 1996- 1997 budget. BACKGROUND/DISCUSSION: The City Council, at their regular meeting of July 16, 1996, awarded the contract in the amount of $463,439.00 to J.E.G. Construction, Inc., the lowest responsible bidder. The final construction contract amount was $438,896.52. This is a total of $24,542.48 saved from the original contract amount. On November 27, 1996, a final job walk was conducted with J.E.G. This matter came to the Commissions attention as a result of potential visibility restriction for motorists exiting from Plaza Diamond Bar's southerly driveway, Prior to the City of Diamond Bars incorporation, the County of Los Angeles installed "No Stopping Anytime" signs along the eastside of Brea Canyon Road from Pathfinder Road to Golden Springs Drive (See Exhibit"A"), Due to the missing signs, however, motorists park along this side of Brea Canyon Road between Pathfinder Road and Plazas southerly driveway, According to the businesses within Plaza Diamond Bar and its management company, John Burnham & Company, the vehicles thatare parked in the area in discussion are carpoolers. This request is based on the need to enhance the visibility distance for motorists who exit out of the shopping center. The intersection of Pathfinder Road and Brea Canyon Road is a signalized T - intersection. At the northeast quadrant of the intersection, there are various businesses and restaurants within Plaza Diamond Bar. At the northwest quadrant there are office buildings. Both the center and office building have parking facilities. According to our records, neither the businesses or occupants of the office building have expressed a shortage of parking spaces. Prior to the City of Diamond Bar's incorporation, the County of Los Angeles installed "No Stopping Anytime" signs along the east side of Brea Canyon Road from Pathfinder Road to Golden Springs Drive. Due to the missing or lack of "No Stopping Anytime" signs, however, parking has occurred on this side of Brea Canyon Road between Pathfinder Road and south of the Plaza's first driveway. Parking remains restricted north of the Plaza's first driveway. Staff has confirmed with the County that a "No Stopping Anytime" zone was established in 1975. It is likely that the east side of Brea Canyon Road is being utilized for parking by those shopping at the center. The Plaza has thirty-seven tenants (3 vacancies) and 274 on-site parking spaces. Brea Canyon Road from Pathfinder Road to the Plaza's first driveway has horizontal and vertical curvatures that may impact motorists' line of sight. When Page Two Brea Canyon Road/Pathfinder Road November 8, 1996 vehicles are parked on this segment of Brea Canyon Road, the visibility distance of those who wish to exit out of the shopping center is affected. In addition, motorists who make right -turns from Pathfinder Road onto Brea Canyon Road need to do so with care, since visibility is impacted by vehicles parked close to the intersection. Staff has notified all businesses in the Plaza and its management company, John Burnham & Company, and occupants of the office building. In order to enhance visibility distance for those exiting Plaza Diamond Bar as well as those making right -turns from westbound Pathfinder Road onto northbound Brea Canyon Road, staff recommends the reinstallation of the previously existing parking restriction, "No Stopping Anytime" signs, along the east side of Brea Canyon Road from Pathfinder Road to Plaza Diamond Bar's first driveway. It has twelve (with 1 handicap parking space) on-site parking spaces. It houses a soccer field, ball field, a top lot for BBQ, and a play area. Those attending the park as well as residents in the area utilize Forest Canyon Drive for parking, which could restrict visibility if vehicles are parked too close to the drive approach. Grow Park - CSD/Rose stated staff received a request from Quail Summit Elementary School Principal Carolyn Haugen, for the City to install red curbing in the parking lot of Paul C. Grow Park. The request is for red curbs at the entrance to the park and along the curb behind the existing parking stalls. It is anticipated that red curbs will reduce the number of cars parking in this small lot, thereby increasing the visibility of pedestrians (especially children) entering the lot. This request was prompted by an incident in which a child was almost hit by a car several weeks ago. The Traffic and Transportation Commission recently considered and approved the red curb painting along Forest Canyon Drive for a distance of twenty feet on each side of the driveway leading to the parking lot of Paul C. Grow Park. Staff recommends that the Parks and Recreation Commission recommend to the City Council the painting of the requested curbs to red at Paul C. Grow Park. The City's Public Works contractor has estimated a cost of $128.10 to paint 210 linear feet (61 cents per linear foot) if done in conjunction with a scheduled job. VC/Finnerty stated the school is asking the City to cooperate in diverting a potential problem. She indicated it is her opinion that it would be in the City's best interest to cooperate with the school in order to obtain the school district's cooperation in the future. Under the category of Incidental Transit -Related Street Improvements, the City of Diamond Bar requested funding for one hundred sixteen (116) new street lights along Diamond Bar Boulevard, Currently, Diamond Bar Boulevard serves as a transitroute for MTA Line 4'490 and Foothill Transit Zone Line #482. BACKGROUND/DISCUSSION Vesting Tentative Tract Map No. 47850 is a 57 unit subdivision on 73 acres located in northern Tonner Canyon within significant ecological area No. 15, southerly and easterly of Steeplechase Lane and Wagon Train Lane. The City Council approved the Vesting Tentative Tract Map on June 6, 1995 with certain conditions of approval. Vesting Tentative Tract Map No. 47851 is a 48 unit subdivision on 68 acres located northeast of the intersection of Wagon Train Lane and the northerly terminus of Windmill Drive. The City Council approved the Vesting Tentative Tract Map with certain conditions of approval on June 2, 1992. Vesting Tentative Tract Map No. 48487 is a 15 unit subdivision on 20 acres located northeast of the intersection of Wagon Train Lane and the northerly terminus of Windmill Drive. The City Council approved this Vesting Tentative Tract Map on June 2, 1992 with certain conditions. 1 The subdivider is in the process of completing all of the conditions related to these three maps. As part of that process, he has contacted the Walnut Valley Water District related to the installation of a reclaimed water system as required by the original conditions of approval for these three subdivision maps. The Walnut Valley Water District is very pointed in stating that they will not supply reclaimed water to properties having an elevation in excess of 850 feet above mean sea level at the present time. A copy of the most recent correspondence from the Walnut Valley Water District is attached. All three of the subdivisions exceed 850 feet in elevation. Although this issue was identified at the time the project was approved, the City placed this condition on each tract in the event that there was a change in policy at the Walnut Valley Water District in the interim. Since the cost of installing such a dual system is significant, the subdivider is now requesting that this condition be waived, based on the Walnut Valley Water District's position that reclaimed water will not be provided for these subdivisions. Staff has reviewed the request and discussed the matter with the Walnut Valley Water District. They have restated that they will not provide reclaimed water to any developments in excess of 850 feet above sea level. Based on this information, staff agrees with the request that this condition be waived. BACKGROUND/DISCUSSION The initial Tentative Map application was made to the Planning Commission at a duly noticed public hearing on September 23, 1991. At the November 25, 1991 Planning Commission Meeting Resolution No's. 91-20 and 91-23 recommending approval of Vesting Tentative Tract Map No. 47850 were approved. At the June 6, 1995 City Council meeting, Council adopted Resolution No. 95-24 approving Vesting Tentative Tract No. 47850. Subsequent to approval of Vesting Tentative Tract No. 47850, the applicant applied for modifications to the plans decreasing the number of proposed lots to 57 and modifying the proposed finished elevations of some of the lots. On June 6, 1995, the City Council adopted Resolution No. 95-24 approving these modifications. The conditions of approval require that certain improvements be constructed for this development. As the improvements have not been completed at this time, the Subdivider is prepared to enter into an agreement with the City to construct these improvements as a condition precedent to approval of the final map and has offered surety bonds to secure his performance. The subdivision agreement provides for the construction of all improvements and setting of subdivision monuments within 2 years. The Final Tract Map which subdivides 73 acres into 57 lots has been reviewed by the appropriate agencies and has been found to be technically correct and conforms substantially to the approved vesting tentative tract map. Minor modifications to the map include (1) relocating the knuckle of Steeplechase Lane by approximately 12' such that it is located entirely on the applicant's property thereby eliminating the need to obtain an easement from the adjacent property owner and (2) making minor improvements to Hawkwood and dedicating these improvements to the City. The final map meets the requirements of the conditions of approval. The City has received correspondence from David F. Freeman representing the adjacent property owner requesting that the City Council not approve Final Tract Map No. 47850 until a legal issue between the applicant and the adjacent property owner has been resolved.
