HomeMy WebLinkAbout9/23/20031 1 MINUTES OF THE CITY OF DIAMOND BAR REGULAR MEETING OF THE PLANNING COMMISSION SEPTEMBER 23, 2003 CALL TO ORDER: Chairman Tye called the meeting to order at 7:00 p.m. in the South Coast Air Q ality Management/Government Center Auditorium, 21865 East Copley Drive, iamond Bar, California 91765. PLEDGE OF ALLEGIANCE: Commissioner Tanaka led the Pledge of Allegiance. 1. ADMINISTRATION OF OATH OF OFFICE FOR PLANNING COM ISSION R. Lynda Burgess, City Clerk, administered the Oath of Office to Osma Wei. 2. ROLL CALL: Present: Chairman Steve Tye; Vice Chairman Dan Nolan; Commissioners Steve Nelson; Jack Tanaka; and Osman�nd ei. Also present: James DeStefano, Deputy City Manager; Ann Lu gu, Associate Planner; Linda Smith, Development Services Assistant; and Stella Marquez, Administrative Assistant. 3. MATTERS FROM THE AUDIENCE/PUBLIC COMMENTS: None Offered. 4. APPROVAL OF AGENDA: As presented. 5. CONSENT CALENDAR: 5.1 Approval of September 9, 2003, Regular Meeting minutes. VC/Nelson moved, C/Tanaka seconded, to approve the Se ten 2003, Regular Meeting minutes as presented. The motion was so with C/1Nei abstaining. 6. OLD BUSINESS: None 7. NEW BUSINESS: None SEPTEMBER 23, 2003 8, PUBLIC HEARINGS: Page 2 PLANNING COMMISSION 8.1 Development Review No. 2003-02 {pursuant to Code Sections 22.44 is a request to amend the following Articles/Sections of the Development Code. ARTICLE 11 Section 22.10.030., Table 2-5 -- Allowed Uses and Permit Requirements for Office Zoning Districts and Table 2-6 — Allowed Uses and Permit Requirements for Commercial/Industrial Zoning Districts: Amendment relates to changing the permit process for psychic readers from a Conditional Use Permit to staff review and allowing this use in the specified zones by right. ARTICLE IV Sections 22.44.020., Table 4-1 — Authority for Land use and Zoning Decisions: Amendment relates to adding an existing City permit process to Table 4-1, and deleting a permit process no longer utilized. Section 22.46.020. — Zoninq Clearances Applicabilit T Amendment relates to further clarifying an existing City permit process. Section 22.47.010. and 22.47.020 — Piot Plan Review — Purpose and Applicabili Amendment relates to adding and clarifying an existing City permit process. Section 22.48.020. — Development Review — Applicability: Amendment relates to further clarifying an existing City permit process. ARTICLE VI Section 22.80.020-. — Definition of specialized Terms and Phrases: Amendment relates to modifying the definition of an `Inoperable Vehicle" and "Psychic Readers." Staff recommends th t the Pla ping Commission adopt a resolution recommending City Counc I approvI of Development Code Amendment No. 2003-02. C/Tanaka asked if the definition of Inoperable Vehicle designated the location of the vehicle. Does it matter whether it is in front oft the house in a side yard or in a back yard? DCM/DeStefano responded "no." DCM/DeStefano explained that in accordance with court rulings, the Fo une Teller/Psychic Reader land use could no longer be required to obtain a Conditional Use Permit. As a result, this type of land use is considered to be no different from the long list of uses permitted in any commercial location within the City. DCM/DeStefano clarified for Chair/Tye that in certain locatio�s on property that are visible to the public, Inoperable Vehicles are disall Responding to VC/Nolan, DCM/DeStefano explained that 7E new refer to the building permits that were issued. PLANNING COMMISSION COMM ENTSA NFORMATIONAL ITEMS: VC/Nolan felt the Timber Ridge sign was unacceptable in its appearance and asked if staff could require the developer to remedy the situation. He appreciated AA/Marquez's email advising Commissioners of current issues relevant to the Commission. C/Wei has observed people collecting vehicles for restoration. Their garages are filled with operable vehicles and there was no additional room for storage of the inoperable vehicle. Are those considered Inoperable Vehicles under the Code? DCM/DeStefano responded, "Yes, they are." For example, if an inoperable vehicle is parked in front of the garage door it is a technical violation of the Code. The vehicle should be moved so that it is not visible from the street. The restoration should be conducted out of the public view (in the rear yard or in the garage) so that it does not detract from the surrounding residences. Chair/Tye welcomed Mr. Wei to the Planning Commission. Mr. Wei replaces a "venerable veteran." 10. STAFF COMMENTS/INFORMATIONAL ITEMS: DCM/DeStefano stated that the ongoing saga involving the North Diamond Bar automobile dealer resulted today in notice to the business operator to remove vehicles that exceed the allocated number permitted as well as, to remove a variety of signs on-site. DCM/DeStefano referred to a packet of information pulled from the Internet site for the Southern California Association of Governments (SCAG). Staff encouraged all Planning Commissioners and their spouses and neighbors to participate in the interactive "Visioning" workshop at the Diamond Bar SCAQMD on Wednesday, October 29 — 6:00 to 9:30 p.m. to participate in the process of determining what the community should look like 30 years from now. DCM/DeStefano welcomed Commissioner Wei. 10.1 Public Hearing dates for future projects. DCM/DeStefano responded to Chair/Tye that the Council/Commission informal dinner is slated for September 29.
