HomeMy WebLinkAbout5/22/2001MINUTES OF THE CITY OF DIAMOND BAR ri REGULAR MEETING OF THE PLANNING COMMISSION MAY 22, 2001 CALL TO ORDER: Chairman Zirbes called the meeting to order at 7:05 p.m. in the South Coast Air Quality Management Auditorium, 21865 East Copley Drive, Diamond Bar, California. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Commissioner Tye. 1. ROLL CALL: Present:, Chairman Bob Zirbes, Vice Chairman Joe Ruzicka, and Commissioners George Kuo, Steve Nelson and Steve Tye. Also Present: James DeStefano, Deputy City Manager, Ann J. Lungu, Associate Planner, and Stella Marquez, Administrative Secretary. 2. MATTERS FROM THE AUDIENCE/PUBLIC COMMENTS: None offered. 3. APPROVAL OF AGENDA: As presented. 4. CONSENT CALENDAR: 4.1 Minutes of the Regular Meeting of April 24, 2001. VC/Ruzicka moved, C/Tye seconded, to approve the minutes for the regular April 24, 2001, meeting as corrected. (Delete Tye from the Aye vote in the first line on page 6). Motion carried by the following Roll Call vote: AYES: COMMISSIONERS: Kuo,. CONTINUED PUBLIC HEARING: 7.1 Development Review No. 2000-22 (pursuant to Code Section 22.48.020) is a request to construct a two story single family residence of approximately 10,630 square feet. Staff recommends that the Planning Commission deny Development Review No. 2000-22. l ti . Chair/Zirbes re -opened the public hearing.+; William Laughlin, 22835 Rio Lobos Road, said he has lived in the tract since 1986. He is confused about the size of the project as stated in tonight's agenda as opposed to the mailing he received. He is concerned about the location on a busy hairpin curve and about the construction of a six car garage at street level. He also has a concern about constructing such a large dwelling on that hillside because of thepre-school located; below the proposed structure. For these reasons, he objects to the approval;of this project. Chair/Zirbes closed the public hearing. VC/Ruzicka said he is concerned about the size of the proposed project with respect to the surrounding neighborhood. He does not believe the project matches the neighborhood because it mansionizes the area and creates a traffic problem. C/Tye stated he agrees with VC/Ruzicka. This project is not consistent with the General Plan's Objective 2.2 and 3.2. The Commission has asked the applicant for seven items that have not been provided and he believes that every effort has been made to accommodate this applicant. Therefore, it would be wise to deny this application. MAY 22, 2001 PAGE 3 PLANNING COMMISSION Chair/Zirbes concurred with VC/Ruzicka and C/Tye's reasons for denial of the proposed project. VC/Ruzicka moved, C/Tye seconded, to deny Development Review No. 2000-22. Motion carried by the following Roll Call vote: AYES: COMMISSIONERS: Kuo, Nelson, Tye, VC/Ruzicka, Chair/Zirbes NOES: COMMISSIONERS: None ABSENT: COMMISSIONERS: None 8. PUBLIC HEARING: 8.1 Variance No. 2001-04 and Minor Conditional Use Permit 2001-04 (pursuant to Code Sections 22.54.020.D, 22.56.020.B., and 22.68.030.B.) is a request to construct a lattice patio cover of approximately 248 square feet to an existing single-family residence of approximately 2,100 square feet. The Variance relates to proposed lot coverage of approximately 41.2 percent, which exceeds the maximum allowed lot coverage of 30 percent. The Minor Conditional Use Permit relates to the legal nonconforming status of the residential structure due to the existing side yard setbacks and existing lot coverage. VC/Ruzicka moved, C/Nelson seconded, to approve Variance No. 2001-04, Minor Conditional Use Permit 2001-04, Findings of Fact, and conditions of approval, as listed within the resolution. Staff recommends that the Planning Commission approve recornmend approval to the City Council of Development Code Amendment No. 2001-01, Negative Declaration No. 2001-02, and Findings of Fact, as listed within the resolution. Chair/Zirbes opened the public hearing. There being no one who wished to speak on this matter, Chair/Zirbes closed the public hearing. C/Nelson moved, VC/Ruzicka seconded, to recommend approval to the City Council of Development Code Amendment No. 2001-01 and Negative Declaration No. 2001-02, Findings of Fact, as listed within the resolution. DCM/DeStefano stated that the JCC zone change will be presented to the City Council on June 5, 2001. The Development Code Amendments will be scheduled before the City Council as their agenda dictates over the next few weeks. There is continued interest in a couple of the larger commercial properties within or adjacent to the community. The city is currently recruiting to fill the Development Services Assistant vacancy, which will take several months. He thanked the Planning staff and in particular, AssocP/Lungu for assuming the extra duties during his tenure as Interim City Manager. i 11.
