HomeMy WebLinkAbout2/27/2001MINUTES OF THE CITY OF DIAMOND BAR REGULAR MEETING OF THE PLANNING COMMISSION FEBRUARY 27, 2001 CALL TO ORDER: Chairman Nelson called the meeting to order at 7:14 p.m. in the South Coast Air Quality Management Auditorium, 21865 East Copley Drive, Diamond Bar, California. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Commissioner Ruzicka. 1. ROLL CALL: Present: Chairman Steve Nelson, Vice Chairman Bob Zirbes, and Commissioners Steve Tye, 2. 3. 4. 5. and Joe Ruzicka. Commissioner Kuo arrived at 7:18 p.m. Also Present: Ann J. Lungu, AssociatePlanner, Linda Smith, Development Services Assistant, Sonya Joe, Development Services Assistant, and Stella Marquez, Administrative Assistant. MATTERS FROM THE AUDIENCE/PUBLIC COMMENTS: None offered. APPROVAL OF AGENDA: As Agendized. CONSENT CALENDAR: 4.1 Minutes of the February 13, 2001, Meeting. C/Ruzicka moved, VC/Zirbes seconded, to approve the minutes of February 13, 2001, as presented. Motion carried by the following Roll Call vote: AYES: COMMISSIONERS: Tye, Ruzicka, VC/Zirbes, Chair/Nelson NOES: COMMISSIONERS: None ABSENT: COMMISSIONERS: Kuo OLD BUSINESS: None NEW BUSINESS: None CONTINUED PUBLIC HEARING: None FEBRUARY 27, 2001 PAGE 2 8. PUBLIC HEARING: PLANNING COMMISSION p t,. 8.1 Variance No. 2001-01/ Minor Conditional Use Permit No. 2001-01 (pursuant to Code Sections 22.54, 22.22.56.020(B), and 22.68.030(B)) is a request to permit a 416 square foot patio cover. A Variance is required due to the patio cover's encroachment into the rear setback and site coverage of 35 percent. A Minor Conditional Use Permit is required for the expansion of a legal non -conforming structure. PROPERTY ADDRESS: 1860 Ano Nuevo Drive (Lot 165 of Tract No. 27979) Diamond Bar, CA 91765 PROPERTY OWNER/ Vasan Srinivasan APPLICANT: 1860 Ano Nuevo Drive Diamond Bar, CA 91765 DSA/Smith presented staff's report. Staff recommends that the Planning Commission approve Variance No. 2001-01/ Minor Conditional use Permit No. 2001-01, Findings of Fact, and conditions of approval, as listed within the resolution. Chair/Nelson opened the public hearing. Chair/Nelson closed the public hearing. VC/Zirbes moved, C/Ruzicka seconded, to approve Variance No. 2001-01/Minor Conditional Use Permit No. 2001-01, Findings of Fact, and conditions of approval, as listed within the resolution. C/Kuo asked if it is within the Planning Commission's authority to approve a Variance that will impact the rear yard by more than 50 percent. DSA/Smith responded that the Development Code is not specific as to the percentage of variance. A Variance is a discretionary review.
