HomeMy WebLinkAbout7/17/1992CITY OF DIAMOND BAR MINUTES OF THE ADMINISTRATIVE DEVELOPMENT REVIEW JULY 17, 1992 CALL TO ORDER: The meeting was called to order at 6:00 p.m., at City Hall, 21660 East Copley Drive, the Conference Room, Diamond Bar, California. ROLL CALL: Community Development Director James DeStefano and Planning Technician Ann Lungu. Also present were the property owners Michael and Dorothea Riley, contractor/ applicant Perry Hanstad, with Design Rite Construction, and neighbor Stanley Kojder, residing at 2300 S. Haddock. OLD BUSINESS: PT/Lungu reported that Administrative Development Review No. 92-0§ is a request, by Michael and ADR 92-9 Dorothea Riley, to construct a first and second story addition of 1,205 sq. ft. to an existing single family residence located at 23001 Haddock Dr., Diamond Bar. The public hearing was continued from the July 13, 1992 so that additional information could be provided concerning the CC&R's, and the existing two-story "homes in the area. It was determined that the CC&R's do exist for this area. However, the DBIA has indicated that the CC&R's for the address of the project area are lost. The World Title Company was then contacted, and they will be sending a copy of the CC&R's to the City as soon as possible. The City does not enforce CC&R's. It was also determined that the County of Los Angeles approved 2 two story additions, probably by means of a plot plan review, for this area. The specific addresses are indicated in the staff report. Furthermore the staff report indicates two existing two story homes which were approved through LA County, probably by plot plan review as well. Based upon this information, and the information in the July 13, 1992 staff report, staff recommended that the Community Devlopment Director approve ADR No. 92-9. The Public Hearing was declared opened. Michael Riley, the applicant, presented staff with a copy of his written rebuttal, and requested that it be made an attachment to the final report of finding. He made the following points: staff has recommended approval of this project; the three homeowners, who presented that petition, are not present to voice their objections; the only basis for that petition is for personal dislike; there are existing two story homes in the area; and the City is not responsible for enforcing CC&R's. He requested that his application be approved for the reason indicated. He also provided several photos in support of his application. -- July 17, 1992 Page 2 The Public -Hearing was declared closed. DCD/DeStefano stated that he can either approve the project with conditions, deny the project with conditions, or send the application to the Planning Commission. He summarized the following primary issues regarding the project: it must meet City code and Development Review criteria; and it must reflect the prevailing characteristics of the neighborhood. Though he is interested in the CC&R's, he indicated that he is not really too concerned with it since the City does not enforce CC&R's and that the CC&R's don't preclude 2 story homes. Noting that no one from the 6 properties, surrounding the project, and espcially no one who was protesting the project, was present at either public hearing, he approved the -project.
