SUBJECT: Adoption of the 1993 General Plan
ISSUE STATEMENT: The General Plan is a statement of goals, policies and
implementing programs to guide the long-range physical development of the
City. The Plan is required by State Law and determines the size, form and
character of the City over the next twenty years. In March of 1993 the City
Council authorized the retention of a consultant team to further develop the
Draft General Plan. Five community workshops were conducted with residents
in April and May to identify key planning issues and discuss potential
General Plan policy options. Since May 19, 1993, ten Public Hearings have
been conducted (nine City Council, one Planning Commission) to solicit public
input and consider adoption of the 1993 General Plan.
The 1993 General Plan is, as a result of the public participation process,
significantly different than the previous General Plan. Future residential
development has been reduced from 6235 additional dwelling units to 1900
theoretical units, substantial policy changes have been incorporated
responding to environmental issues, and significant policy statements are
included responding to regional traffic impacts upon the City.
The purpose of the public hearing is to provide a final opportunity for
public commentary on the 1993 General Plan prior to adoption.
RECOMMENDATION: It is recommended that the City Council open the public
hearing, receive a presentation from the General Plan consultant team,
conclude public testimony and adopt the 1993 General Plan.
BACKGROUND: The General Plan is comprised of policies which will guide the
long range social, cultural, economic, and physical development of the
community. State law requires each new city to adopt such a comprehensive
long range planning document within the first 30 months of existence. The
General Plan represents the community's view of its future and serves as the
"blueprint" for the city's vision. It is the most significant tool utilized
by the community to create and assure a balanced, comfortable environment in
which to live, work, and play.

The City of Diamond Bar has been in existence for over four years. Diamond
Bar does not yet have its required General Plan. This primarily is the
result of a referendum which was filed against a General Plan which the City
Council adopted in July 1992. The City Council repealed the adopted General
Plan in March 1993. Since that time, the City has been working on the
preparation of the 1993 General Plan.
Over the past several months, the City has conducted five public workshops to
provide community members an opportunity to help identify potential General
Plan policy issues and options. The primary issues identified through these
workshops include: the amount and type of future residential development,
openspace identification and preservation, and traffic circulation, and
related transportation system improvements.
The City Council has held nine public hearings which began May 19, to solicit
public input on the policy issues incorporated into the 1993 General Plan.
Required by State Law, the 1993 General Plan expresses, in the form of text,
maps, and illustrations, the organization of physical, economic, and social
activities sought_ by the community in order to create and maintain a
functional, healthful, and desirable place in which to live and do business.
The General Plan serves as a comprehensive strategy for the management of
future growth and change over the next twenty years.
The adopted General Plan will be a useful guide for local decision making.
To provide for logical and orderly development, the General Plan addresses
issues concerning public services, the economic vitality of the community,
and environmental constraints. Land use and policy determinations can thus
be made within a comprehensive framework which incorporates public health,
safety, and "quality of life" considerations.
According to State guidelines for the preparation of general plans, the role
of the General Plan is to establish a document which will " ..act as a
'constitution' for development, the foundation upon which all land use
decisions are to be based. It expresses community development goals and
embodies public policy relative to the distribution of future land use, both
public and private."
Thus, the General Plan serves to:
■ Identify land use, circulation, environmental, fiscal, and social
goals and policies for the City and its surrounding planning area
as they relate to land use and development.
■ Provide a framework within which the Planning Commission and City
Council'can make land use decisions.
■ Provide citizens the opportunity to participate in the planning and
decision making process affecting the City and its planning area.
■ Inform citizens, developers, decision makers, and other agencies,
as appropriate, of the City's basic rules which will guide
development within the City and provide similar notice as to how
the City envisions development in the surrounding unincorporated
portions of the planning area.

State law requires that the General Plan include seven mandatory elements
(the Land Use Element, the Circulation Element, the Housing Element, the
Conservation Element, the Open -Space Element, the Noise Element and the
Safety Element). In addition to the elements required by State law, the
Diamond Bar General Plan will include an optional Public Services and
Facilities Element.
It is important that the 1993 General Plan establish local policy, while
keeping in mind that the City is part of a larger region. Certain issues,
such as traffic and air quality, have a local component, but are more readily
addressed on a regional basis. In such cases, the task of the General Plan
will be to integrate the interests, values, and concerns of the people of
Diamond Bar with regional and countywide policies. In addition, it is the
purpose of the 1993 General Plan to provide a forum for the discussion and
resolution of issues that cannot be solved by the City alone, but that
require cooperative actions by a number of jurisdictions.
DISCUSSION: On July 13, 1993, the City Council received a second Draft 1993
General Plan. The document contained changes, inclusions, deletions and
other modifications to the base General Plan document.
The major areas of significant or substantive change within the 1993 General
Plan include:
1. Map and text changes related to the former General Plan's
theoretical buildout of 6235 additional residential dwelling units. The
1993 General Plan indicates that 1900 additional dwelling units may be
developed over the next twenty years as a result_ of its policies.
However, with specific development review standards and site
constraints, staff believes that the reality for future residential
growth in Diamond Bar is approximately half the theoretical amount.
2. Incorporation of substantial language responding to environmental
concerns and environmental sensitivity related to a regional bypass
transportation corridor as well as recognition of Significant Ecological
Area No. 15 and further defining significant impacts to be reviewed
before a project is considered for approval.
3. Incorporation of transportation policy statements responding to
Diamond Bar's position as a recipient of regional traffic. Strong
proactive statements regarding regional traffic mitigation, the need to
work with other agencies and jurisdictions toward common solutions, and
consideration of an environmentally sensitive regional traffic bypass
roadway.
4. A vision statement which incorporates the retention of rural country
living characteristics of the community, preservation of open space
resources, reduction of regional traffic impacts on local streets,
promoting viable commercial activity, and the provision for a well
maintained, attractive and hospitable community environment are
incorporated.
As a result of comments and direction received at the July 20, 1993, hearing,
addendum pages are attached for review. The July 27, 1993, continued public
hearing provides an opportunity for additional commentary on the 1993 General
Plan prior to adoption.

ENVIRONMENTAL, DETERMINATION: The City Council adopted and approved a Final
Environmental Impact Report (FEIR) for the 1992 General Plan on July 14,
1992. The FEIR identified all significant environmental effects of the 1992
General Plan. A range of alternatives and their environmental effects were
also evaluated within the FEIR.
The changes considered in the 1993 General Plan will not result in any new or
more adverse impacts not already considered within the FEIR. Therefore, an
addendum to the FEIR has been prepared in accordance with the California
Environmental Quality Act (CEQA) for the 1993 Diamond Bar General Plan.
PUBLIC NOTIFICATION:
Public hearing notices for the five General Plan workshops were published
within the San Gabriel Valley Tribune and Inland Valley Daily Bulletin in
accordance with State Law. In addition, public notices were published within
the Diamond Bar and Walnut Highlander, and the Windmill. Posters announcing
the General Plan workshop and public hearing process have been circulated
within the community.
Public hearing notices for the nine City Council Meetings were previously
published within the San Gabriel Valley Tribune and Inland Valley Daily
Bulletin in accordance with State Law. In addition, public notices were
published within the Diamond Bar Highlander. The July 27 public hearing of
the City Council represents the tenth public hearing conducted since May 19,
1993. Notice of each public hearing has been mailed to several hundred
persons or organizations as represented on our General Plan mailing list.
All General Plan documents have been available for review at City Hall and
the County Library.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DIAMOND BAR ADOPTING A GENERAL PLAN FOR'
THE CITY OF DIAMOND BAR
A. Recitals.
(i) The City of Diamond Bar previously initiated
proceedings to adopt a general plan (111992 General Plan")
pursuant to Title 7, Division 1 of the California Government Code
Sections 65360 and 65361.
(ii) A Ceneral Plan Advisory Com-mittee was formad to
provide the community with an opportunity to participate in the
creation of the City of Diamond Bar's 1992 General Plan and to
make recommendations with respect to the specific components of
the 1992 General Plan. Numerous study sessions and duly noticed
public hearings were held by the Planning Corlmission and the City
Council of the City of Diamond Bar from July 1991 through July
1992.
(iii) Pursuant to the California Environmental Quality
Act of 1970, as amended, and the Guidelines promulgated
thereunder ("CEQA"), a Draft and Final Environmental Impact
Report was prepared and considered to address the environmental
effects of the 1992 General Plan, the mitigation measures related
to each significant environmental effect of the 1992 General
Plan, the project alternatives and a Mitigation Monitoring Plan.
(iv) On July 30, 1991, copies of the draft 1992
General Plan were mailed to affected agencies pursuant to
Government Code Section 65352.
(v) On July 14, 1992 the City Council adopted
Resolution No. 92-44 adopting the 1992 General Plan and adopted
Resolution 92-43 certifying the Final Environmental Impact Report
for the 1992 General Plan.
(vi) On or about August 10, 1992, a referendum petition
seeking the repeal of Resolution No. 92-44 was submitted to the
City Clerk of the City of Diamond Bar. The City Clerk certified
the sufficiency of the signatures on the referendum petition
pursuant to a court order and presented such certification to the
City Council.
(vii) On March 16, 1993 the City Council adopted
Resolution No. 93-15 repealing Resolution No. 92-44, the
resolution which adopted the 1992 General Plan.

(viii) In March. of 199" the City council directed the
retention of a consultant team to develop a new general plan
(411993 General Plan"). Opportunities for, public participation:
were provided throughout the program of creating the 1993 General
Plan. Five community workshops were hold with City residents to
identify key planning issuers and to discuss potential general
plan policy options. The results of those workshops were
summarized and forwarded to the City Council for its
consideration.
(ix) After consideration of the comments received at
the community workshops, the 1992 General Plan. was substantially
modified. These significant modifications will result in the
development of less residential housing by reducing the
residential densities to reflect the existing development
densities. These changes in the residential densities will
result in the reduction of the estimated number of additional
residential units at buildout from 6,235 under the 1992 General
Plan to 1,900 under the 1993 General Plan. In addition, the 1993
General Plan contains a new vision statement which more
forcefully expresses the City's goals of protecting
environmentally sensitive areas of the City. The 1993 General
Plan specifically recognizes and delineates the Significant
Ecological Area 15 located within the central part of the sphere
of influence and strengthens the goals, policies and programs
related.to the preservation of open space. Further, the Tres
xermanos area land use designation has bean changed from
Agriculture to Agriculture/Specific Plan in order to acknowledge
the short term goal of retaining the Agricultural designation
until such time as a specific development plan is submitted to
the City. Finally, the regional transportation corridor
proposed to be located in Tonner Canyon is now proposed to be
located in the eastern portion of the sphere of influence and
outside of Significant Ecological Area 15.
(x) On May.19, 1993, the City council began the public
hearing process to adopt a general plan. The City Council held
duly noticed public hearings on May 19, 1993, May 26, 1993, June
2, 1993, June 9, 1993 and June 16, 1993, whereby public testimony
was received with respect to all elements of the draft 1993
General Plan.
(xi) Because substantial modifications to the draft
1993 General Plan were being considered, the City Council,
pursuant to Government Code Section 65356, referred the review of
the draft 1993 General Pian to the Diamond Sar Planning
Commission for its recommendations. on June 23, 1993 the
Planning Commission held a study session to consider the draft
1993 General Pian, On June 26, 1993 the Planning Commission
conducted a duly noticed public hearing to consider and receive
public testimony on the draft 1993 General Plan. The Planning
Commission considered all the evidence presented and submitted a
written recommendation to the City Council to adopt the draft
1993 General Plan, with various modifications.

(xii) On June 29, July 6, July 13, Juiy 20 and July 27,
1993 the City Council conducted additional duly noticed public
hearings. In the course of these public hearings, the City
Council received and deliberated upon written and oral testimony
from members of the public, City staff, state agencies, local
agencies, consultants, and Commissions of the City.
(xiii) Although the modifications to the 1992 General
Plan are substantial, the Final Environmental .Impact Report
previously prepared adequately addresses all of the significant
environmental impacts associated with the 1993 General Plan.
Only technical changes or additions were required to be made to
the Final Environmental Impact Report in order to consider the
Final Environmental Impact Report adequate under CEQA.
Therefore, an Addendum was prepared and considered in accordance
with CEQA. The City Council considered the information contained
in the Final Environmental Impact Report and the Addendum thereto
('Final EIR") prior to approval of the 1993 General Plan.
(xiv) The City Council considered, individually and
collectively, the six elements comprising the 1993 General Plan,
the related appendices and the Final EIR. The 1993 General Plan
incorporates the seven mandatory elements established iii
Government Code Section 65302 into six components, specifically:
a. The Land Use Element;
b. The Housing Element]
C. The Resource Management Element (open Space
and Conservation Elements);
d. The Public Health and safety Element (Noise
and Safety Elements);
e. The Circulation Element; and
f. The Public Services and Facilities Element
(xv) In its review of the 1993 General Plan and the
Final EIR, the City Council fully considered the impacts upon
landforms and topography, earth resources and seismicity,
drainage and flood control, biological resources, crime and
prevention services, fire hazards and protective services, health
and emergency services, hazardous materials, recreation and open
space, land use, air quality, noise, cultural resources,
socioeconomics (housing), energy systems, circulation/
transportation, educational services, water, wastewater, and
solid waste associated with the further development of the City
in accordance with the goals, policies and programs as more fully
detailed in the 1993 General Plan.
(Xvi) The 1993 General Plan and all of its constituent
parts are properly integrated, internally consistent and
compatible.
(xvii) The City Council has considered all the
information presented to it, and found and determined that the
public convenience, welfare and good planning practice require

the adoption and implementation of the goals, policies and
programs contained in the 1993 General Plan.
()'viii) All Legal prerequisites prior to the adoption
of this Resolution have occurred.
H. Resolution.
NOW, THEREFORE, it is hereby found, determined and
resolved by the City Council of the City of Diamond Bar, as
follows:
1. The City Council of the City of Diamond Bar hereby
Specifically finds that all of the facts set forth in the
Recitals, Part A, of this Resolution are true and correct and are
hereby incorporated into the body of this Resolution by
reference.
2. Documentation has been prepared in compliance with
CEQA and this City Council has reviewed and considered the
information contained in the environmental documentation,
including the Final Environmental Impact Report, the Addendum and
the Mitigation Monitoring Plan with respect to the 1993 General
Plan, and has determined that such documentation is complete and
adequate.
3. The City Council hereby determines that:
(a) The six components of the 1993 Diamond Bar
General Plan, including all appendices, completely address the
mandatory elements, and the mandatory legal contents required
therein, pursuant to California Government Code Section 65302 and
all other applicable statutes. The 1993 General Plan is incorpo-
rated herein by this reference as though set forth in full.
(b) The 1993 General Plan is informational,
readable, and available to the public pursuant to California
Government Code section 65357..
(c) The six components of the 1993 General Plan,
including appendices, are internally consistent as required by
California Government Code Section 65300.5.
(d) The 1993 General Plan is consistent with
State of California policies, rules, regulations and guidelines.
(e) The 1993 General Plan covers all territory
within the corporate boundaries of the City of Diamond Bar and
further, incorporates all lands outside the corporate boundaries
of the City of Diamond Bar which the City Council has judged to
bear a reasonable relationship to Diamond Bar's planning
activities pursuant to California Government Code Section 65300.
(f) The 1993 General Plan is long term in
perspective pursuant to California.Government Code Section 65300.
(g) The 1993 General Plan reasonably addresses
all relevant local issues and concerns currently identified.

4. The City Council of `he City of Diamond Bar hereby
finds that adoption of the 1993 General Plan will generate
social, economic and other benefits which clearly outweigh the
unavoidable adverse environmental impacts, as specified in the
Statement of Overriding Considerations set forth in Exhibit A of
Resolution No. 93-_.
5. The City Council of the City of D_anond Bar hereby
finds that the 1993 General Plan for the City of Diamond Bar was
prepared in accordance with California State Planning and Zoning
Law, particularly Title 7, Chapter 3 of the California Government
Code and the General Plan Guidelines promulgated by the
Governor's Office of Planning and Research. .
6. The City Council hereby approves and adopts the
1993 General Plan as the General Plan of the City of Diamond Bar.
7. The City Clerk shall certify to the adoption of
this Resolution.

REFERENCE AND CERTIFYING THE, ADEQUACY OF THE
ADDENDUM TO THE GENERAL PLAN ENVIRONMENTAL IMPACT
REPORT AND MAKING FINDINGS THEREON
PURSUANT TO THE CALIFORNIA ENVIRONNMENTAL
QUALITY ACT
A. Recitals.
(i) The City of Diamond Bar previously initiated
proceedings to adopt a general plan (101992 General Plan")
pursuant to Title 7, Division 1 of the California Government Code
Sections 65360 and 65361.
(ii) Pursuant to the California Environmental Quality
Act of 1970, as amended, and the Guidelines promulgated
thereunder ("CEQA"), a Draft and Final Environmental Impact
Report was prepared and considered to address the environmental
effects of the 1992 General Plan, the mitigation measures related
to each significant environmental effect of the 1992 General
Plan, the project alternatives and a mitigation monitoring
program.
(iii) Pursuant to Section 15087 of the California Code
of Regulations, a 45 day comment period was provided to all
affected agencies for review of the Draft Environmental Impact
Report. Written comments were received and were responded to in
the "Response to Comments" contained in the Final Environmental
impact Report.
(iv) The Planning Commission conducted duly noticed
study sessions on July 22, August 12 and August 26, 1991 to
consider and receive public testimony with respect to the Draft
Environmental Impact Report prepared for the 1992 General Pian.
The Planning Commission conducted duly noticed public hearings
With respect to the Draft Environmental Impact Report where it
received public testimony and duly considered all testimony on
September 9 and September 23, 1991 and on April 13, April 20,
April 27, May 4, May 11, May 18, May 21, May 26, May 28, June 1
and June 8, 1992.
(v) The Planning Commission reviewed all ,environmental
documentation comprising the Draft Environmental Impact Report
and found that the documents considered all environmental effects
of the 1992 General Plan, that they were complete and adequate,
and that they fully complied with all requirements of CEQA.

(vi) On June 8, 1992 the Planning Commission
recommended to the City Council, that the Draft Environmental
Impact Report be certified as complete and adequate. On June 9,
June 26, June 30, July 7 and July 14, 1992, the City Council
conducted duly noticed public: hearings to consider and receive
public testimony regarding the Draft and Final Environirental
Impact Report.
(vii) on July 14, 1992 the City Council adopted
Resolution No. 92-44 adopting the 1992 General Plan and adopted
Resolution 92-43 certifying the Final Environmental Impact Report
for. the 1992 General Plan.
(viii) on or about August 10, 1992, a referendum
petition seeking the repeal of Resolution No. 92-44 was submitted
to the City Clerk of the City of Diamond Bar. The City Clerk
certified the sufficiency of the signatures on the referendum
petition pursuant to a court order and presented such
certification to the City Council. On March 16, 1993 Reaolution
No. 92-44 was repealed.
(ix) In March of 1993 the City Council directed the
retention of a consultant team to develop a new general plan
(111993 General Plan"). Opportunities for public participation
were provided throughout the program of creating the 1993 General
Plan. Five community workshops were held with City residents to
identify key planning issues and to discuss potential general
plan policy options. The results of those workshops were
summarized and forwarded to the City Council for its
consideration.
(x) After consideration of the comments received at
the community workshops, the 1992 General Plan was substantially
modified. These significant modifications will result in the
development of less residential housing by reducing the
residential densities to reflect the existing development
densities. These changes in the residential densities will
result in the reduction of the estimated number of additional
residential units at buildout from 6,235 under the 1992 General
Plan to 1,900 under the 1993 General Plan. In addition, the 1993
General Plan contains a new vision statement which more
forcefully expresses the City's goals of protecting
environmentally sensitive areas of the City. The 1993 General
Plan specifically recognizes and delineates the Significant
Ecological Area 15 located within the central part of the sphere
of influence and strengthens the goals, policies and programs
related to the preservation of open space. Further, the Tres
Hermanos area land use designation has been changed from
Agriculture to Agriculture/Specific Plan in order to acknowledge
the short term goal of retaining the Agricultural designation
until such time as a specific development plan is submitted to
the City. Finally, the regional transportation corridor
proposed to be located in Tonner Canyon is now proposed to be

located in the eastern portion of the sphere of infli.ence and
outside of Significant Ecological Area 15.
(xi) On May 19, 1993, the City Council began the public
hearing process to adopt a general plan. 'rhe City Council held
duly noticed public hearings on May 19, 1993, May 26, 1993, June
2, 1993, June 9, 1993 and June 16, 1993 whereby public testimony
was received with respect to all elements of the draft 1993
General Plan.
(xii) Because substantial modifications to the draft
1993 General Plan ;were being considered, the City Council,
pursuant to Government Code Section 65356, referred the review of
the draft 1993 General Plan to the Diamond Bar Planning
Commission for its recommendations. On June 23, 1993 the
Planning Commission held a study session to consider the draft
1993 General flan. On June 28, 1993 the Planning Commission
conducted a duly noticed public hearing to consider and receive
public testimony on the draft 1993 General Plan. The Planning
Commission considered all the evidence presented and submitted a
written recommendation to the City Council to adopt the draft
1993 General Plan, with various modifications.
(xiii) On June 29, July 6, July 3.3, July 20 and July
27, 1993 the City Council conducted additional duly noticed
public hearings, In the course of these public hearings, the
City Council received and deliberated upon written and oral
testimony from members of the public, City staff, State agencies,
local agencies, consultants, and Commissions of the City.
(xiv) Although the modifications to the 1992 General
Plan are substantial, the Final Environmental Impact Report
previously prepared and certified adequately addresses all of the
significant environmental, impacts associated with the 1993
General Plan. Only technical changes or'additions were required
to be made to the Final Environmental Impact Report in order to
consider the Final Environmental Impact Report adequate under
CEQA. Therefore, an Addendum was prepared and considered in
accordance with CEQA. The City Council considered the
information contained in the Final Environmental Impact Report
and the Addendum thereto prior to approval of the 1993 General
Pian. Further, the mitigation measures contained in the Final
Environmental Impact Report which was prepared in connection with
the 1992 General Plan remain, current and valid and a revised
Mitigation Monitoring Program ("Mitigation Monitoring Program")
is hereby made a part of the Final Environmental Impact Report
for the 1993 General Plan to ensure implementation of the
Mitigation measures identified in the Final Environmental impact
Report.
(xv) In its review of the 1993 General Plan, the Final
Environmental Impact Report and the Addendum, the City Council
fully considered the impacts upon local land use, circulation,
housing, air quality, biological resources, recreation and open

(xvi) All legal prerequisites prior to the adoption of
this Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and
resolved by the City Council of the City of Diamond Bar, as
follows.
1. The City Council of the City of Diamond Bar hereby
specifically finds that all of the facts set forth in the
Recitals, Part A, of this Resolution are true and correct and are
hereby incorporated into the body of this Resolution by
reference.
2. The Final Environmental Impact Report, prepared
pursuant to CEQA, and certified and adopted in Resolution No. 92-
43 on July 14, 1992, is hereby incorporated herein by this
reference as though set forth in full in connection with the 1993

General Plan which avoid or substantially lessen the significant
individual and cumulative environmental effects identified in the
Final Environmental Impact Report and Addendum.
4, This City council finds that the Final
Environmental Impact Report and Addendum have described a range
of reasonable alternatives to the 1993 General Plan which could
feasibly obtain the basic objectives of the General Plan.
Further, this City council finds that a good faith effort was
made to incorporate alternatives in the preparation of the Draft
Environmental Impact Report and a range of reasonable
alternatives were considered in the review process of the Final
Environmental Impact Report and Addendum and ultimate decisions
on the 1993 General Plan. The City Council has evaluated the

Environmental Impact Report and Addendum identify certain
significant unavoidable environmental effects that will result if
the 1993 General Plan is adopted, all significant effects that
can feasibly be mitigated or avoided have been reduced to the
extent feasible by the imposition of mitigation measures
contained within the Final Environmental Impact Report and
Addendum and the Mitigation Monitoring Program and the social,
economic and other benefits of the project outweigh those
unavoidable impacts. Therefore, the City Council finds that the
unavoidable environmental impacts of the 1993 General Plan are
acceptable when balanced against the benefits of the project.
6. This City Council hereby adopts the following
Statement of Overriding Considerations:
(a) The City Council finds that while changes or
alterations have been required in, or incorporated into the 1993
General Plan which substantially lessen the significant
environmental effects as identified in the Final Environmental
Impact Report and Addendum, these effects cannot be totally

avoided or reduced to a level of insignificance if the project is
implemented.
(b) To the extent that the 1993 Diamond Bar
General Plan allows the occurrence of significant effects

.insignificance, the City Council has identified specific
economic, ecological, and social reasons to support its action
which make infeasible the project alternatives described in the
Final Environmental Impact Report and Addendum.
The Final Environmental Impact Report and Addendum
identify the following unavoidable adverse impacts which may
occur upon implementation of the 1993 General Plan:
(i) Biological Resources:
+ Loss of vegetation and wildlife displaced
from potential development areas.
+ Potential removal of woodlands and
riparian brush.
(ii) Transportation/Circulation: Contribution to
the local and area -wide need for expanded
transportation systems.
(iii) Air Quality:
+ Short -terra air quality impacts associated
with the construction phases of development
such as from construction equipment.

make infeasible the alternatives described in the Final
Environmental Impact Report and Addendum are set forth below:
(i) The 1993 General Plan will provide for a
community with a balance of land uses and a range of residential
housing types.
(ii) The 1993 General Plan is superior to the
proposed alternatives, including the "no project" alternative, in

that it promotes an enviro-(mental=y and visually sensitive
pattern of growth, provides For an environmental balance between
development and identified naturai resources and promotes

superior ability to preserve the significant natural resources'of
the City and its sphere of influence and will enhance the
protection of visually sensitive areas.
(iv) The 1993 General Plan provides greater
assurances than the alternatives proposed, including the "no
project:" alternative, that where development does occur in or
adjacent to visually sensitive areas, such development will occur
in a manner which minimizes effects upon resources.
(v) The 1993 General Plan will assure that
geologic and safety considerations influence the preparation of
development plans and proposals and requires that such
considerations are reflected in each development proposal,
including requirements for architecture and site design which are
sensitive to the topography and the significant natural resources
of the City and its sphere of influence.
(vi) The 1993 General Plan will encourage a
safe and convenient system of circulation and access which is
responsive to local and regional considerations, and will provide
adequate levels of public services, facilities and utilities
which are properly sequenced to ensure that such necessary public
services, facilities and utilities are in place in conjunction

with development as it occurs in a manner zuperior to that which
would be provided through the other alternatives, including the

be required and will be implemented in an equitable fashion.
(viii) Each alternative analyzed in the Final
Environmental Impact Report, including the "no project"
alternative, produce unavoidable adverse impacts. The 1993
General Plan is superior to each of the alternatives presented,
including the "no project" alternative, in that it minimizes such
unavoidable adverse impacts throughout the City and its sphere of
influence to the extent feasible.
(d) The City Council finds that facts supporting
the above-specified findings are contained in the Final.
Environmental Impact Report and Addendum, she 1993 General Plan
text, and the information provided to this council during the
public hearings conducted with respect to the 1993 General Plan
and the Final Environmental Impact Report and Addendum. The
mitigation measures which are contained in the Final
Environmental Impact Report and Addendum and the Mitigation
Monitoring Program, are made a condition, of approval of the 1993

significantly different than the previous General Plan. Future residential
development has been reduced from 6235 additional dwelling units to 1900
theoretical units, substantial policy changes have been incorporated
responding to environmental issues, and significant policy statements are
included responding to regional traffic impacts upon the City.
The purpose of the public hearing is to provide a final opportunity for
public commentary on the 1993 General Plan prior to adoption.

BACKGROUND: The General Plan is comprised of policies which will guide the
long range social, cultural, economic, and physical development of the
community. State law requires each new city to adopt such a comprehensive
long range planning document within the first 30 months of existence. The
General Plan represents the community's view of its future and serves as the

The City of Diamond Bar has been in existence for over four years.

Bar does not yet have its required General Plan. This primarily
the
result of a referendum which was filed against a General Plan which the City
Council adopted in July 1992. The City Council repealed the adopted General
Plan in March 1993. Since that time, the City has been working on the
preparation of the 1993 General Plan.
Over the past several months, the City has conducted five publicwirlshopsGeneto
provide community members an opportunity to help identify p

Plan policy issues and options. The primary issues identified through these
workshops include: the amount and type of future residential development,
openspace identification and preservation, and traffic circulation, and
related transportation system improvements.
The City Council has held nine public hearings which began May 19, to solicit
public input on the policy issues incorporated into the 1993 General Plan.
Required by State Law, the 1993 General Plan expresses, in the form of text,
maps, and illustrations, the organization of physical, economic, and social
activities sought by the community in order to create and maintain a
functional, healthful, and desirable place in which to live and do business.
The General Plan serves as a comprehensive strategy for the management of
future growth and change over the next twenty years.
The adopted General Plan will be a useful guide for local decision making.
To provide for logical and orderly development, the General Plan addresses
issues concerning public services, the economic vitality of the community,
and environmental constraints. Land use and policy determinations can thus
be made within a comprehensive framework which incorporates public health,
safety, and "quality of life" considerations.
According to State guidelines for the preparation of general plans: cta

of the General Plan is to establish a document which will

decisions are to be based. It expresses community development goals and
embodies public policy relative to the distribution of future land use, both
public and private."
Thus, the General Plan serves to:
Identify land use, circulation, environmental, fiscal, and social
goals and policies for the City and its surrounding planning area
as they relate to land use and development.
■ Provide a framework within which the Planning Commission and City
Council can make land use decisions.
Provide citizens the opportunity to participate in the planning and
decision making process affecting the City and its planning area.
■ Inform citizens, developers, decision makers, and other agencies,
as appropriate, of the City's basic rules which will guide
development within the City and provide similar notice as to how
the City envisions development in the surrounding unincorporated
portions of the planning area.

State law requires that the General Plan include seven mandatory elements
(the Land Use Element, the Circulation Element, the Housing Element, the
Conservation Element, the Open -Space Element, the Noise Element and the
Safety Element).
In addition to the elements required by State law, the
Diamond Bar General Plan will include an optional Public Services and
Facilities Element.
It is important that the 1993 General Plan establish local policy, while
keeping in mind that the City is part of a larger region. Certain issues,
such as traffic and air quality, have a local component, but are more readily
addressed on a regional basis. In such cases, the task of the General Plan
will be to integrate the interests, values, and concerns of the people
Diamond Bar with regional and countywide policies. In addition, it is the
purpose of the 1993 General Plan to provide a forum for the discussion and
resolution of issues that cannot be solved by the City alone, but that
require cooperative actions by a number of jurisdictions.
DISCUSSION: On July 13, 1993, the City Council received a second Draft 1993
General Plan. The document contained changes, inclusions, deletions and
other modifications to the base General Plan document.
The major areas of significant or substantive change within the 1993 General
Plan include:
1. Map and text changes related to the former General Plan's
theoretical buildout of 6235 additional residential dwelling units. The
1993 General Plan indicates that 1900 additional dwelling units may
e
developed over the next twenty years as a result of its p s
However, with specific development review standards and site
constraints, staff believes that the reality for future residential
growth in Diamond Bar is approximately half the theoretical amount.
2. Incorporation of substantial language responding to environmental
concerns and environmental sensitivity related to a regional bypass
transportation corridor as well as recognition of Significant Ecological
Area No. 15 and further defining significant impacts to be reviewed
before a project is considered for approval.
3. Incorporation of transportation policy statements responding to
Diamond Bar's position as a recipient of regional traffic. Strong
proactive statements regarding regional traffic mitigation,
the need to
work with other agencies and jurisdictions toward common solutions, and
consideration of an environmentally sensitive regional traffic bypass
roadway.
4. A vision statement which incorporates the retention of rural country
living characteristics of the community, preservation of open space
resources, reduction of regional traffic impacts on local streets,
promoting viable commercial activity, and the provision for a well
maintained, attractive and hospitable community environment are
incorporated.
As a result of comments and direction received at the July 20, 1993, hearing,
addendum pages are attached for review. The July 27, 1993, continued public
hearing provides an opportunity for additional commentary on the 1993 General
Plan prior to adoption.

ENVIRONMENTAL DETERMINATION: The City Council adopted and approved a Final
Environmental Impact Report (FEIR) for the 1992 General Plan on July 14,
1992. The FEIR identified all significant environmental effects of the 1992
General Plan. A range of alternatives and their environmental effects were
also evaluated within the FEIR.
The changes considered in the 1993 General Plan will not result in any new or
more adverse impacts not already considered within the FEIR. Therefore, an
addendum to the FEIR has been prepared in accordance with the California
Environmental Quality Act (CEQA) for the 1993 Diamond Bar General Plan.
PUBLIC NOTIFICATION:
Public hearing notices for the five General Plan workshops were published
within the San Gabriel Valley Tribune and Inland Vallev Daily Bulletin in
accordance with State Law. In addition, public notices were published within
the Diamond Bar and Walnut Highlander, and the Windmill. Posters announcing
the General Plan workshop and public hearing process have been circulated
within the community.
Public hearing notices for the nine City Council Meetings were previously
published within the San Gabriel Valley Tribune and Inland Valley Daily
Bulletin in accordance with State Law. In addition, public notices were
published within the Diamond Bar Highlander. The July 27 public hearing of
the City Council represents the tenth public hearing conducted since May 19,
1993. Notice of each public hearing has been mailed to several hundred
persons or organizations as represented on our General Plan mailing list.
All General Plan documents have been available for review at City Hall and
the County Library.

REFERENCE AND CERTIFYING THE ADEQUACY OF THE
.ADDENDUM TO THE GENERAL PLAN ENVIRONMENTAL IMPACT
REPORT'—AND MAKING FINDINGS THEREON
PURSUANT TO THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
A. Recitals.
(i) The City of Diamond Bar previously initiated
proceedings to adopt a general plan ("1992 General Plan11)
pursuant to Title 7, Division 1 of the California Government Code
Sections 65360 and 65361.
(ii) Pursuant to the California Environmental Quality
Act of 1970, as amended, and the Guidelines promulgated
thereunder ("CEQA"), a Draft and Final.Environme.ntal Impact
Report was prepared and considered to address the environmental
effects of the 1992 General Plan, the mitigation measures related
to each significant environmental effect of the 1992 General
Plan, the project alternatives and a mitigation monitoring
program.
(iii) Pursuant to Section 15087 of the California Code
of Regulations, a 45 day comment period was provided to all
affected agencies for review of the Draft Environmental Impact
Report. Written comments were received and were responded to in
the "Response to Comments" contained in the Final Environmental
Impact Report.
(iv) The Planning Commission conducted duly noticed
study sessions on July 22, August 12 and August 26, 1991 to
consider and receive public testimony with respect to the Draft
Environmental Impact Report prepared for the 1992 General Pian.
The Planning commission conducted duly noticed public hearings
with respect to the Draft Environmental Impact Report where it
received public testimony and duly considered all testimony on
September 9 and September 23, 1991 and on April. 13, April 20,
April 27, May 4, May 11, May 18, May 21, May 26, May 28, June 1
and June 8, 1992.
(v) The Planning Commission reviewed all environmental
documentation comprising the Draft Environmental Impact Report
and found that the documents considered all environmental effects
of the 1992 General Plan, that they were complete and adequate,
and that they fully complied with all requirements of CEQA.

(vi) On June 8, 1992 the Planning Comrr,ission
recommended to the City Council that the Graft Environmental
Impact Report be certified as complete and adequate. On June 9,
June 26, June 3.0, July 7 and July 14, 1992, the City Council
conducted duly noticed public hearings to consider and receive
public testimony regarding the Draft and Final Enviro;ur.ental
Impact Report.
(vii) on July 14, 1992 the City Council adopted
Resolution No. 92-44 adopting the 1992 General Plan and adopted
Resolution 92-43 certifying the Final Environmental TTnpact Report
for the 1992 General Plan.
(viii) on or about August 10, 1992, a referendum
petition seeking the repeal of Resolution No. 92-44 was submitted
to the City Clerk of the City of Diamond Bar. The City Clerk
certified the sufficiency of the signatures on the referendum
petition pursuant to a court order and presented such
certification to the City Council. On March 16, 1993 Resolution
No. 92-44 was repealed.
(ix) In March of 1993 the City Council directed the
retention of a consultant team to develop a new general plan
(111993 General Plan"). Opportunities for public participation
were provided throughout the program of creating the 1993 General
Plan. Five community workshops were held with City residents to
identify key planning issues and to discuss potential general
plan policy options. The results of those workshops were
summarized and forwarded to the City Council for its
consideration.
(x) After consideration of the comments received at
the community workshops, the 1992 General Plan was substantially
modified. These significant modifications will result in the
development of less residential housing by reducing the
residential densities to reflect the existing development
densities. These changes in the residential densities will
result in the reduction of the estimated number of additional
residential units at buildout from 6,235 under the 1992 General
Plan to 1,900 under the 1993 General Plan. In addition, the 1993
General Plan contains a new vision statement which more
forcefully expresses the City's goals of protecting
environmentally sensitive areas of the City. The 1993 General
Plan specifically recognizes and delineates the Significant
Ecological Area 15 located within the central part of the sphere
of influence and strengthens the goals, policies and programs
related to the preservation of open space. Further, the Tres
Kermanos area land use designation has been changed from
Agriculture to Agriculture/specific Plan in order to acknowledge
the short term goal of retaining the Agricultural designation
until such time as a specific development plan is submitted to
the City. Finally, the regional transportation corridor
proposed to be located in Tonner Canyon is now proposed to be

located in the eastern portion of the sphere of influence and
outside of Significant Ecological Area 15.
(xi) On May 19, 1993, the City Council began the public
hearing process to adopt a general plan. The City Council held
duly noticed public hearings on May 19, 1993, May 26, 1993, June
2, 1993, June 9, 1993 and June 15, 1993 whereby public testimony
was received with respect to ail elements of the draft 1993
General Plan.
(xii) Because substantial modifications to the draft
1993 General Plan were being considered, the City Council,
pursuant to Government code Section 65356, referred the review of
the draft 1993 General Plan to the Diamond Bar Planning
Commission for its recommendations. On June 23, 1993 the
Planning Commission held a study session to consider the draft
1993 General Plan. On June 28, 1993 the Planning Commission
conducted a duly noticed public hearing to consider and receive
public testimony on the draft 1993 General Plan. The Planning
Commission considered all the evidence presented and submitted a
written recommendation to the City Council to adopt the draft
1993 General Plan, with various modifications.
(xiii) on June 29, July 6, July 13, July 20 and July
27, 1993 the City Council conducted additional duly noticed
public hearings. In the course of these public hearings, the
City Council received and deliberated upon written and oral
testimony from members of the public, City staff, State agencies,
local agencies, consultants, and Commissions of the City.
(xiv) Although the modifications to the 1992 General
Plan are substantial, the Final Environmental Impact Report
previously prepared and certified adequately addresses all of the
significant environmental, impacts associated with the 1993
General Plan. only technical changes or'additions were required
to be made to the Final Environmental Impact Report in order to
consider the Final Environmental Impact Report adequate under
CEQA. Therefore, an Addendum was prepared and considered in
accordance with CEQA. The City Council considered the
information contained in the Final Environmental Impact Report
and the Addendum thereto prior to approval of the 1993 General
Pian. Further, the mitigation measures contained in the Final
Environmental Impact Report which was prepared in connection with
the 1992 General Plan remain current and valid and a revised
Mitigation Monitoring Program ("Mitigation Monitoring Program")
is hereby made a part of the Final Environmental Impact Report
for the 1993 General Plan to ensure implementation of the
mitigation measures identified in the Final Environmental Impact
Report.
(xv) In its review of the 1993 General Plan, the Final
Environmental impact Report and the Addendum, the City Council
fully considered the impacts upon local land use, circulation,
housing, air quality, biological resources, recreation and open

City in accordance with the goals, policies and programs as more

this Resolution have occurred.
a. Resolution.
NOW, THEREFORE, it is hereby found, determined and
resolved by the City Council of the City of Diamond Bar, as
follows:
1. The City Council of the City of Diamond Bar hereby
specifically Finds that all of the facts set forth in the
Recitals, Part A, of this Resolution are true and correct and are
hereby incorporated into the body of this Resolution by
reference.
2. The Final Environmental Impact Report, prepared
pursuant to CEQA, and certified and adopted in Resolution No. 92-
43 on July 14, 1992, is hereby incorporated herein by this
reference as though set forth in full in connection with the 1993
General Plan. The Addendum, prepared pursuant to CEQA, is hereby
certified and adopted by this City Council in connection with the
1993 General Plan. The environmental findings made in Resolution
No. 92-43 and additional environmental findings, attached hereto
as Exhibit "A," are hereby incorporated by this reference and
adopted.
3. The City Clerk shall certify to the adoption of
this Resolution.

1. 'rhe City Council finds that the final
Environmental Impact Report was certified as being completed in
compliance with the Ca._i.forni Environmental Quality Act of 1970,
as amended, and the guidelines promulgated thereunder by
Resolution 92-43, adopted on July 14, 1992. The Addendum to the
Final Environmental Impact Report, prepared in :�onnecti.on with
the adoption of the City of Diamond Bar 1993 General Plan, was
completed in compliance with the California Environmental Quality
Act of 1970, as amended, and the guidelines promulgated
thereunder, and is nereby made a part of the Final Environmental
Impact Report. The City Council has reviewed and considered the
information contained in the Final Environmental Impact Report
and Addendum and the Final Environmental Impact Report and
Addendum reflect the independent judgment of the City of Diamond
Bar.
2. This City Council finds that the Final
Environmental Impact Report and Addendum have identified all
significant environmental effects of the 1993 General Plan and
that there are no known potential environmental impacts not
addressed in the Final Environmental Impact Report and Addendum.
This City Council further finds that the Final Environmental
Impact Report and Addendum identify significant individual and
cumulative environmental effects of the project in regard to
landforms and topography, earth resources and seismicity,
drainage and flood control, biological resources, crime and

prevention sexvices, fire hazards and protective services, health
and emergency services, hazardous materials, recreation and open
Space, land use, air quality, noise, cultural resources,
socioeconomics ;housing), energy systems, circulation/
transportation, educational services, water, wastewater, and
solid waste. The City Council finds that the Final Environmental
Impact Report and Addendum identify all feasible mitigation
measures for these impacts.
3. The City Council finds that in response to each
significant effect identified in the Final Environmental Impact
Report and Addendum and listed in Section 2, changes or
alterations have been required in, or incorporated into, the
General Plan which avoid or substantially lessen the significant
individual and cumulative environmental effects identified in the
Final Environmental Impact Report and Addendum.
4. This City Council finds that the Final
Environmental Impact Report and Addendum have described a range
of reasonable alternatives to the 1993 General Flan which could
feasibly obtain the basic objectives of the General Plan.
Further, this City Council finds that a good faith effort was
made to incorporate alternatives in the preparation of the Draft
Environmental Impact. Report and a range of reasonable
alternatives were considered in the review process of the Final
Environmental Impact Report and Addendum and ultimate decisions
on the 1993 General Plan. The City Council has evaluated the

comparative merits of the alternative� and resected them as
infeasible for economic, social or oti,er considerations as set
forth in Section 6 of this Resolution, or Lecause such
alternatives are not, as a whole, more environmentally protective
than the proposed 1993 General Plan.
5. This city Council finds that although the Final
Environmental Impact Report and Addendum identify certain
significant unavoidabie environmental effects that will result if
the 1993 General Plan is adopted, all significant effects that
can feasibly be mitigated or avoided have been reduced to the
extent feasible by the imposition of mitigation measures
contained within the Final Environmental impact Report and
Addendum and the Mitigation Monitoring Program and the social,
economic and other benefits of the project outweigh those
unavoidable impacts. Therefore, the City Council finds that the
unavoidable environmental impacts of the 1993 General Plan are
acceptable when balanced against the benefits of the project.
6. This City Council hereby adopts the following
Statement of Overriding considerations:
(a) The City council finds that while changes or
alterations have boon required in, or incorporated into the 1993
General Plan which substantially lessen the significant .
environmental effects as identified in the Final Environnental
Impact Report and Addendum, these effects cannot be totally

avoided or reduced to a level of insignificance if the project is
implemented.
(b) To the extent that the 1993 Diamond Bar
General plan allows the occurrence of significant effects
identified in the Final Environmental Impact Report and Addendum
which cannot be totally avoided or reduced to a level of
insignificance, the City Council has identified specific
economic, ecological, and social reasons to support its action
which make infeasible the project alternatives described in the
Final Environmental Impact Report and Addendum.
The Final Environmental Impact Report and Addendum
identify the following unavoidable adverse impacts which may
occur upon implementation of the 1993 General Plan:
(i) Biological Resources:
+ Loss of vegetation and wildlife displaced
from potential development areas.
+ Potential removal of'woodlands and
riparian brush.
(ii) Transportation/Circulation: Contribution to
the local and area -wide need for expanded
transportation systems.
(iii) Air Quality:
+ Short-term air quality impacts associated
with the construction phases of development
such as from construction equipment.

+ Long-term stationary and mobile source air
emission, increases
(iv) Acoustic Environment:
+ Short-term acoustic impacts during grading,
infrastructure installation and building
construction.
+ Long-term acoustic impacts occurring from
increased traffic and urban activities.
(v) Land Use: Potential alteration of open space
and agricultural lands within the City.
(vi) Public Services and Facilities:
Increased demands on fire, police protection,
schools, libraries, health services, solid waste
disposal and telephone services; increased
consumption of water and energy supplies; and
increased waste -water generation/treatment
demands.
(c) The economic, ecological and social reasons
which support the adoption of the 1993 General Plan and which
make infeasible the alternatives described in the final
Environmental Impact Report and Addendun are set forth below:
(i) The 1993 General Plan will provide for a
community with a balance of land uses and a range of residential
housing types,
(ii) The 1993 General Plan is superior to the
proposed alternatives, including the "no project" alternative, in

that it promotes an environmental -'y and visually sensitive
pattern of growth, provides for an environmental balance between
development and identified natural resources and promotes
superior regulations for balancing the requirements of
environmental preservation, safety and economic consideration.
(iii) The 1993 General Plan provides a
superior ability to preserve the significant natural resources'of
the City and its sphere of influence and will enhance the
protection of visually sensitive areas.
(iv) The 1993 General Plan provides greater
assurances than the alternatives proposed, including the "no
project" alternative, that where development does occur in or
adjacent to visually sensitive areas, such development will occur
in a manner which minimizes effects upon resources.
(v) The 1993 General Plan will assure that
geologic and safety considerations influence the preparation of
development plans and proposals and requires that such
considerations are reflected in each development proposal,
including requirements for architecture and site design which are
sensitive to the topography and the significant natural resources
of the City and its sphere of influence.
(vi) The 1993 General Plan will encourage a
safe and convenient system of circulation and access which is
responsive to local and regional considerations, and will provide
adequate levels of public services, facilities and utilities
which are properly sequenced to Ensure that such necessary public
services, facilities and utilities are in place in conjunct+on

with development as it occur -s in a manner=uperior to that which
would be provided through the other alternatives, including the
"no project" alternative.
(vii) The 1393 General Plan will promote the
establishment of adequate funding mechanisms in order to provide
identified infrastructure and circulation improvements which will
be required and will be implemented in an equitable fashion.
(viii) Each alternative analyzed in the Final
Environmental Impact Report, including the "no project"
alternative, produce unavoidable adverse iinpacts. The 1993
General Plan is superior to each cf the alternatives presented,
including the "no project" alternative, in that it minimizes such
unavoidable adverse impacts throughout the City and its sphere of
influence to the extent feasible.
(d) The City council finds that facts supporting
the above-specified findings are contained in the Final
Environmental Impact Report and Addendum, --he 1993 General Plan
text, and the information provided to this Council during the
public hearings conducted with respect to the 1993 General Plan
and the Final Environmental Impact Report and Addendum. The
mitigation measures which are contained in the Final
Environmental impact Report and Addendum and the Mitigation
Monitoring Program, are made a condition, of approval of the 1993
General Plan and are intended to mitigate and/or avoid the
significant environmental effects identified in the Final
Environmental Impact Report and Addendum. The 1993 General Plan

7. This city Council hereby specifically finds and
determines that, based upon the findings set forth herein and
changes and alterations which have been incorporated into the
1993 General Plan, the adverse environmental effocts of the 1993
General Plan are acceptable.
B. This City Council hereby adopts the Mitigation
Monitoring Program required by Public Resources Code section
21081.8 and contained in the Final Environmental Impact Report
and Addendum as an integrated component of the 1993 General Plan
and will be implemented accordingly.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY

A. $vitals.
(i) The City of Diamond Bar previously initiated
proceedings to adopt a general plan ("1992 General pian")
pursuant to Title 7, Division 1 of the California Government Code

(ii) A usneral Plan Advisory Committee was _ornad to
provide the community with an opportunity to participate in the
creation of the City of. Diamond Bar's 1992 General Plan and to
make recommendations with respect to the specific components of
the 1992 General Plan. Numerous study sessions and duly noticed
Public hearings were held by the Planning Cormissaion and the City
Council of the City of Diamond Bar from July 1991 through July
1992.
(iii) Pursuant to the California Environmental Quality
Act of 1970, &N amended, and the Guidelines promulgated
thereunder ("CEQA"), a Draft and Final Environmental zmpact
Report was prepared and considered to address the environmental
effects of the 1992 General Plan, the mitigation measures related
to each significant environmental effect of the 1992 General
Plan, the project alternatives and a Mitigation Monitoring Plan.
(iv) On July 30, 1991, copies of the draft 1992
General Plan were mailed to affected agencies pursuant to
Government Code Section 65352.
(v) On July 14, 1992 the City Council adopted
Resolution No. 92-44 adopting the 1992 General Plan and adopted
Resolution 92-43 certifying the Final Environmental Impact Report
for the 1992 General Plan.
(vi) On or about August 10, 1992, a referendum petition
seeking the repeal of Resolution No. 92-44 was submitted to the
City Clerk of the City of Diamond Bar. The City Clerk certified
the sufficiency of the signatures on the referendum petition
pursuant to a court order and presented such certification to the
City Council.
(vii) On March 16, 1993 the City Council adopted

densities. Theme changes in the residential densities will
result in the reduction of the estimated number of additional
residential units at buildout from 6,235 under the 1992 General
Plan to 1,900 under the 1993 General Plan. In addition, the 1993
General Plan contains a new vision statement which more
forcefully expresses the City's goals of protecting
environmentally sensitive areas of the City. The 1993 General
Plan specifically recognize* and delineates the Significant
Ecological Area 15 located within the central part of the sphere
Of influence and strengthens the goals, policies and programs
related to the preservation of open space. Further, the Tres
Hermanos area land use designation has been changed from
Agriculture to Agriculture/Specific Plan in order to acknowledge
the short term goal of retaining the Agricultural designation
until such time as a specific development plan is Submitted to
the City. Finally, the regional transportation corridor
proposed to be located in Tonner Canyon is now proposed to be
located in the eastern portion of the sphere of influence and
outside of Significant Ecological Area 15.
(x) an May 19, 1993, the City Council began the public
hearing process to adopt a general plan. The City Council held
duly noticed public hearings on May 19, 1993, May 26, 1993, June
2, 1993, June 9, 1993 and June 16, 1993, whereby public testimony
was received with respect to all elements of the draft 1993
General Plan.
(xi) Because substantial modifications to the draft
1993 General Plan were being considered, the City Council,
Pursuant to Government Coda Section 65356, referred the review of
the draft 1993 General Plan to the Diamond Bar Planning
Commission for its recommendations. on June 23, 1993 the
Planning Commission held a study session to consider the draft
1993 General Plan. On June 28, 1993 the Planning COMMission
conducted a duly noticed public hearing to consider and receive
Public testimony on the draft 1993 General Plan. The Planning
Commission considered 411 the evidence presented and submitted a
written recommendation to the City Council to adopt the draft
1993 General Plan, with various modifications.

(xii) On June 29, 7111y 6, July 13, July 20 and July 27,
1993 the City Council conducted additional duly noticed public
hearings. In the course of these public hearings, t?-ja City
Council received and deliberated upon wr'_tten and oral testimony
from members of the public, City staff, State agencies, local
agencies, consultants, and Commissions of the City.
(xiii) Although the modifications to the 1992 General
Plan are substantial, the Final Environmental Zmpact Report
previously prepared adequately addresses all of the significant
environmental impacts associated with the 1993 General Plan.
Only technical changes or additions were required to be made to
the Final Environmental Impact Report in order to consider the
Final Environmental Impact Report adequate under CEQA.
Therefore, an Addendum was prepared and ccnsidered in accordance
With CEQA. The City Council considered the information contained
in the Final Environmental Impact Report and the Addendum thereto
('Final EIR") prior to approval of the 1993 General Plan.
(xiv) The City Council considerad, individually and
collectively, the six elements comprising the 1993 General Plan,
the related appendices and the Final EIR. The 1993 General Plan
incorporates the seven mandatory elements established in
Government Code Section 65302 into six components, specifically:
a. The Land Use Element;
b. The Housing Element;
c. The Resource Management Element (Open Space
and Conservation Elements);
d• The Public Health and Safety Element (Noise
and Safety Elements);
e. The Circulation Element; and
f. The Public Services and Facilities Element
(xv) In its review of the 1993 General Plan and the
Final EIR, the City Council fully considered the impacts upon
landforms and topography, earth resources and seismicity,
drainage and flood control, biological resources, crime and
prevention services, fire ha2ards and protective services, health
and emergency services, hazardous materials, recreation and open
space, land use, air quality, noise, cultural resources,
socioeconomics (housing), energy systems, circulation/
transportation, educational services, water, wastewater, and
solid waste associated with the further development of the City
in accordance with the goals, policies and programs as more fully
detailed in the 1993 General Plan.
(Xvi) The 1993 General Plan and all of its constituent
parts are properly integrated, internally consistent and
compatible.
(xvii) The City Council has considered all the
information presented to it, and found and determined that the
Public convenience, welfare and good planning practice require

the adoption and irr.plementation of the goals, policies and
programs contained in the 1993 General Plan.
(xviii) All 1e9a1 prerequisites prior to the adoption
of this Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and
resolved by the City Council of the City of Diamond Bar, as
follows:
1• The City Council of the City of Diamond Bar hereby
specifically finds that all of the facts set .forth in the
Recitals, Part A of this Resolution are true and correct and are
hereby incorporated into the body of this Resolution by
reference.
2. Documentation has been prepared in Compliance with
CEQA and this City Council has reviewed and considered tale
information Contained in the environmental documentation,
including the Final Environmental Impact Report, the Addendum and
the Mitigation Monitoring Plan with respect to the 1993 General
Plan, and has determined that such documentation is Complete and
adequate.
3. The City Council hereby determines that:

within the corporate boundaries of the City of Diamond Bar and
further, incorporates all lands outside the corporate
of the City of Diamond Bar which the City Council judgedrtos
bear a reasonable relationship to Diamond Bar's planning
activities pursuant to California Government Code Section 65300.

social, economic and other benefits which clearly outweigh the
unavoidable adverse environmental impacts, as specified in the
Statement of Overriding Considerations set forth in Exhibit A of
Resolution No. 93
5. The City Council of the City of DJamond bar hereby
finds that the 1993 General Plan for the City of Diamond Bar was
prepared in accordance with California State Planning and Zoning
Law, particularly Title 7, Chapter 3 of the California Government
Code and the General Plan Guide?ines promulgated by the
Governor's Office of Planning and Research. _
