SUBJECT: Review of the General Plan - Land Use Element
ISSUE STATEMENT:
The General Plan expresses a comprehensive strategy for the management of
growth and change within the community throughout the next twenty years. on
June 9 the City Council began a series of public hearings on the General
Plan. The purpose of the June 23 public hearing is to review the Plan for
Community Development (Land Use Element)
The Land Use Element designates the general location and distribution of land
uses for housing, business, industry, open space, education, public buildings
and other categories of public and private uses.
RECOMMENDATION:
It is recommended that the City Council re -open the public hearing on the
General Plan, receive testimony on and review the Plan for Community
Development (Land Use Element) and continue the public hearing to June 30,
1992.
BACKGROUND:
The City Council began the public hearing process and its review of the
General Plan on June 9, 1992. Since that time, the Council has reviewed the
Plan for Public Services and Facilities and the Plan for Public Health and
Safety.
The purpose of the June 23, 1992, public hearing is to continue public review
of the entire General Plan with specific emphasis on the Plan for Community
Development (Land Use Element).
DISCUSSION:
LAND USE ELEMENT:
The Land Use Element has the broadest scope of the seven mandatory elements
of the General Plan. It contains broad policy which sets forth the
distribution, location, and intensity for all land uses within the City and
our Sphere -of -Influence. Although all General Plan elements carry equal
weight, the Land Use Element is the most publicized and is often perceived as
being the most representative of "The General Plan".

The Land Use Element contains the Land Use map which is a graphic
representation of the policies contained within the element.
The text of the General Plan - Plan for Community Development should be
reviewed in its entirety. Please also review the Master Environmental
Assessment and the EIR for additional background information.
GPAC REVIEW
The GPAC draft Land Use Element represented an overall lowering of density
and development intensity. In order to implement the Land Use Element, as
crafted by GPAC, several hundred acres of land and existing zoning
classifications must be "down zoned" to be made consistent.
GPAC reviewed all remaining open/undeveloped land within the City. As a
result of survey analysis, several parcels were identified as having
development restrictions. Regardless of present zoning, GPAC recommended
that all remaining open/ undeveloped land be downzoned to the Open Space '
classification, public park, or very low density hillside residential
classification. (See Open Land Survey and map contained within the MEA and
EIR).
PLANNING COMMISSION RECOMMENDATIONS
The Planning Commission reviewed the recommendations of GPAC and made several
revisions. Major issues discussed by the Commission include:
► Downzonina
The Commission recommends that existing (developed) single family
residential property be classified consistent with existing zoning.
Most neighborhoods are presently developed at 2-4 units per acre
although "zoned" up to 8 units per acre. The recommendation of the
Commission eliminates the "Downzoning" required by the GPAC.
to. Disposition of Ogen Land
As part of the General Plan program, Planning Network prepared an
"Open Land Survey" to identify restrictions, if any, that may have
been created by Los Angeles County on the use of existing vacant
lands within the City of Diamond Bar as part of earlier subdivision
activity. In reviewing subdivisions, Los Angeles County placed a
number of types of notes and use restrictions on subdivision maps
within what was to become the City of Diamond Bar. These notes and
restrictions ranged from an ambiguous "Parcel is not accepted as a
public park." to clear prohibitions on future development.
In reviewing these notes and restrictions, the General Plan
Advisory Committee recommended that all lands with such notes and
restrictions be designated as "Open Space" on the General Plan Land
Use map. The Planning Commission found, however, that many of the
"restrictions" were ambiguous, while others were not intended by
the County to be permanent, but were intended to require further
hearings in front of the Board of Supervisors. As a result, the
Planning Commission eliminated the GPAC's policy, and made land use
determinations on open lands on a case by case basis. In general,
only lands that were clearly committed to open space, such as the
hillside area behind the Gateway project, were designated as "Open
Space." p

► Planned Development and Specific Plan Designations
The Commission is recommending the use of Planned Development (PD)
and Specific Plan (SP) designations to address the unique needs of
certain land areas. The PD and SP designations would require
detailed, coordinated land plans which, if approved, would permit
development and protect biological and open space resources.

► Maximum Residential Density
In July, 1991, the GPAC draft General Plan permitted a maximum
density of 16 units per acre for certain residential properties.
In April, 1992, GPAC lowered the maximum density to 12 units per
acre. Responding to downzoning concerns, existing
apartment/ condominium densities, and the need for a range of
housing types, the Commission recommends a maximum density of 16
units per acre.
Additionally, the Commission reorganized and restructured the
element to improve clarity and intent.
Attached for your information and use are the following items:
1. Recommended Land Use Map as approved by the Planning Commission
on June 8, 1992.

Corporation dated May 26, 1992, and Sasak Corporation dated May 29,
1992.

Re: City of Diamond Bar's Proposed General Plan

Dear Mr. DeStefano:
Please accept this letter of protest against the proposed General Plan's zoning of
D.B.C. Associates' property. We have submitted proposed tentative maps as Nos. 45290 and
51102 for this property, which consists of approximately 20 acres, as well as preparing
studies other materials for submission with these maps. This property has been under study
for many years. Thousands of dollars, and a great deal of time have been spent in planning
and preparation.
The project as currently proposed is viable and compatible with the existing
community. The value and the price for a home as currently proposed would be feasible
for a homebuyer. The new General Plan designation, if effected, would reduce the density
from our currently proposed 23 units to one unit for every 2.5 acres. This would effectively
render our project financially unfeasible, and our property would be significantly devalued.
The price for a home, based on the proposed zoning, would be completely out of a
reasonable range, based on value, for any potential buyer. In addition, this new zoning
would render the project inconsistent with the surrounding existing single family homes,
which have lot sizes of 7,500 to 10,000 square feet. We do not believe it is the City's
intention to deprive its future residents of homes at a reasonable value, and to cause
community inconsistency.
Please ensure that this letter is presented at each and every discussion regarding
adoption of the proposed General Plan and its rezoning of our property. We request that
zoning of the property remain as it is to accommodate our proposed 23 -lot subdivision.

It has been brought to my attention that the City of Diamond Bar is near completion
of the Draft General Plan. I am the owner of a seven acre parcel located at Morning Sun and
Sheppard Hills Road. I have already commissioned my civil engineer to prepare a tentative
tract map application which is due to be submitted to your office in the very near future.
My purpose in writing is to request that the land use designation that is applied to this
property be consistent with the current zoning of the property. This will allow me to continue
the design work and subdivision application.
Finally, I would appreciate your sending me notice of the hearing date at which the issue
of land use designation will be considered by the City Planning Commission and City Council.

proposed.

ISSUE STATEMENT:
The General Plan expresses a comprehensive strategy for the management of
growth and change within the community throughout the next twenty years. On
June 9 the City Council began a series of public hearings on the General
Plan. The purpose of the June 23 public hearing is to review the Plan for
Community Development (Land Use Element)
The Land Use Element designates the general location and distribution of land
uses for housing, business, industry, open space, education, public buildings
and other categories of public and private uses.
RECOMMENDATION:
It is recommended that the City Council re -open the public hearing on the
General Plan, receive testimony on and review the Plan for Community
Development (Land Use Element) and continue the public hearing to June 30,
1992.
BACKGROUND:
The City Council began the public hearing process and its review of the
General Plan on June 9, 1992. Since that time, the Council has reviewed the
Plan for Public Services and Facilities and the Plan for Public Health and
Safety.
The purpose of the June 23, 1992, public hearing is to continue public review
of the entire General Plan with specific emphasis on the Plan for Community
Development (Land Use Element).
DISCUSSION:
LAND USE ELEMENT•
The Land Use Element has the broadest scope of the seven mandatory elements
of the General Plan. It contains broad policy which sets forth the
distribution, location, and intensity for all land uses within the City and
our Sphere -of -Influence. Although all General Plan elements carry equal
weight, the Land Use Element is the most publicized and is often perceived as
being the most representative of "The General Plan".

The Land Use Element contains the Land Use map which is a graphic
representation of the policies contained within the element.
The text of the General Plan - Plan for Community Development should be
reviewed in its entirety. Please also review the Master Environmental
Assessment and the EIR for additional background information.
GPAC REVIEW
The GPAC draft Land Use Element represented an overall lowering of density
and development intensity. In order to implement the Land Use Element, as
crafted by GPAC, several hundred acres of land and existing zoning
classifications must be "down zoned" to be made consistent.
GPAC reviewed all remaining open/ undeveloped land within the City. As a
result of survey analysis, several parcels were identified as having
development restrictions. Regardless of present zoning, GPAC recommended
that all remaining open/ undeveloped land be downzoned to the Open Space
classification, public park, or very low density hillside residential
classification. (See Open Land Survey and map contained within the MEA and
EIR) .
PLANNING COMMISSION RECOMMENDATIONS
The Planning Commission reviewed the recommendations of GPAC and made several
revisions. Major issues discussed by the Commission include:
► Downzonina
The Commission recommends that existing (developed) single family
residential property be classified consistent with existing zoning.
Most neighborhoods are presently developed at 2-4 units per acre
although "zoned" up to 8 units per acre. The recommendation of the
Commission eliminates the "Downzoning" required by the GPAC.
► Disposition of Open Land
As part of the General Plan program, Planning Network prepared an
"Open Land Survey" to identify restrictions, if any, that may have
been created by Los Angeles County on the use of existing vacant
lands within the City of Diamond Bar as part of earlier subdivision
activity. In reviewing subdivisions, Los Angeles County placed a
number of types of notes and use restrictions on subdivision maps
within what was to become the City of Diamond Bar. These notes and
restrictions ranged from an ambiguous "Parcel is not accepted as a
public park." to clear prohibitions on future development.
In reviewing these notes and restrictions, the General Plan
Advisory Committee recommended that all lands with such notes and
restrictions be designated as "Open Space" on the General Plan Land
Use map. The Planning Commission found, however, that many of the
"restrictions" were ambiguous, while others were not intended by
the County to be permanent, but were intended to require further
hearings in front of the Board of Supervisors. As a result, the
Planning Commission eliminated the GPAC's policy, and made land use
determinations on open lands on a case by case basis. In general,
only lands that were clearly committed to open space, such as the
hillside area behind the Gateway project, were designated as "Open
Space."

► Plan ed ev to ment a d S ecific P a Desi nations
The Commission is recommending the use of Planned Development (PD)
and Specific Plan (SP) designations to address the unique needs of
certain land areas. The PD and SP designations would re
detailed, coordinated land plans which, if approved, would permit
development and protect biological and open space resources.
(Please refer to Objective 1.6 of the Land Use Element.)
► Maximum Residential Deng+
In July, 1991, the GPAC draft General Plan permitted a maximum
density of 16 units per acre for certain residential properties.
In April, 1992, GPAC lowered the maximum density to 12 units per
acre. in Respond
apartment/codomining densities to ownzoning concerns, existing

housing types, the Commission recommends a maximmudensity of 16
units per acre.
Additionally, the Commission reorganized and restructured the
element to improve clarity and intent.

Please accept this letter of protest against the proposed General Plan's zoning of
D.B.C. Associates' property. We have submitted proposed tentative maps as Nos. 45290 and
51102 for this property, which consists of approximately 20 acres, as well as preparing
studies other materials for submission with these maps. This property has been under study
for many years. Thousands of dollars, and a great deal of time have been spent in planning
and preparation. p g
The project as currently proposed is viable and compatible with the existing
community. The value and the price for a home as currently proposed would be feasible
for a homebuyer. The new General Plan designation, if effected, would reduce the density
from our currently proposed 23 units to one unit for every 2.5 acres. This would effective
render our project financially unfeasible, and our roe y
The price for a home, based on the proposed z oning would becompletely out f a
reasonable range, based on value, for any potential buyer. In addition, this new zoning
would render the project inconsistent with the surrounding existing single family homes, have lot sizes of 7,500 to 10,000 square feet. We do not believe it is the City's
intention to deprive its future residents of homes at a reasonable value, and to ca s '
community inconsistency. e

It has been brought to my attention that the City of Diamond Bar is near completion
of the Draft General Plan. I am the owner of a seven acre parcel located at Morning Sun and
Sheppard Hills Road. I have already commissioned my civil engineer to prepare a tentative
tract map application which is due to be submitted to your office in the very near future.
My purpose in writing is to request that the land use designation that is applied to this
property be consistent with the current zoning of the property. This will allow me to continue
the design work and subdivision application.
Finally, I would appreciate your sending me notice of the hearing date at which the issue
of land use desienation will be considered by the City Planning Commission and City Council.
