Attached please find the Resolution and proposed investment policy. This policy is basically the same as the policy adopted for Fiscal Year 1989-90, however there have been some additional items included in the text. The introductory paragraph explains that the idle cash of the City is to be invested according to the prudent man rule. This year, a definition of this rule is included. Also, the requirement for a monthly report of investments has been outlined and included within the policy. Van Nort, City Manager SUBJECT: Development Code Preparation Pursuant to Council direction at the Strategic Planning Workshop, June 14, 1990, this office notified our General Plan consultant, Planning Network, to prepare a proposal for the City's first Development Code. This initially was contained within the General Plan proposal, however, it was removed at the recommendation of the first Planning Director. The proposal costs are reasonable as it relates to the preparation of the General Plan. To prepare separately, would necessi- tate the already undertaken steps of citizen input, Council and staff inter- views. However, there are some areas that may be reduced as an effort of in- creasing the public meetings. It is the opinion of this office that three addi- tional public meetings are necessary. RECOMMENDATION: It is recommended that the City Council authorize an amendment to the Planning Network Contract to prepare the Development Code in an amount not to exceed For- ty Thousand, Three Hundred thirty-five Dollars ($40,335), and that the contract be redefined to allow for three additional meetings. Copley Dr. Diamond Bar, CA 91765 Dear Bob: Thank you for the opportunity to assist the City of Diamond Bar in preparing its Development Code. As we discussed, the development code will have the following attributes: Authority for discretionary actions will be vested in the Planning Commission and City Council; only a few, minor approvals will be made at the staff level. Approval authority for permits and actions other than subdivisions, nonresidential parcel maps, and actions which are required by law to be made at City Council level will be vested with the Planning Commission. Staff actions will be appealable to the Planning Commission and City Council. Planning Commission actions will be appealable to the City Council. • The code will be quantitative in nature. Standards and review processes will be comprehensive and quantified. The standards included in code will ensure a high quality of development. • A preamble will be included, identifying the primary purposes of the development code, including maintaining environmental quality and enhancing the quality of life for the citizens of Diamond Bar. In addition, individual sections of the code will, as appropriate, include statements of intent and purpose, • The development code will contain clear sign regulations which will limit the size of signs to that necessary for identification of businesses. Included as part of sign regulations will be regulations for temporary signs and identifications signs for building complexes in addition to requirements for individual business signage. • Also included in the code will be hillside development regulations. • The development code will include provisions for architectural and design review, including standards and guidelines for site design, buffering, and landscaping. • The ordinance will be written in a formal rather than literary style. The consultant will meet with City staff and decisionmakers to review findings and outline recommended changes to these ordinances. Recommendations for format and content of the revised Development Code will also be prepared. Product: One reproducible of recommended development code format and content will be submitted to the City. Cost: $3,000 Task 2: Development Code Text PLANNING NETWORK will prepare a screencheck Development code based on the conclusions of Task 1. These revisions will be prepared as follows. 2.1 Procedural Requirements A draft development review system for the development code will be prepared. The development review system will be based on interviews with City staff, and will incorporate, revise, streamline, and/or formalize procedures presently used by the City, as appropriate. Where necessary, new review procedures will also be formulated. 2.2 Zoning Classifications and Definitions Zoning classifications and definitions (including overlay zones as appropriate) will be proposed to provide a realistic framework for implementation of a development review system. 2.3 Development Standards and Requirements PLANNING NETWORK will formulate new development standards and requirements in keeping with the desired character and quality of development for the City of Diamond Bar. This will include listings of permitted, conditionally permitted, temporary, and prohibited uses; densities and intensities of use; height, setback, and stepback standards; landscaping, parking, and sign requirements; and standards and requirements for special uses. Standards, requirements, and incentives will be tested to ensure their feasibility and effectiveness. Products: One (1) reproducible of the screencheck development code will be submitted for review. Cost. $29,335 Task 3: Zoning Ordinance Map A proposed zoning ordinance map will be prepared to accompany the draft zoning ordinance in public hearings. City to supply reproducible base map. The zoning map will be based on existing zoning patterns within the City. Along with hearing on the General Plan, a revised zoning map will be prepared, if necessary, to achieve consistency between the proposed General Plan and zoning. This task Includes translating existing zoning into proposed zoning classifications but does not include changing existing zoning patterns. Products: One (1) reproducible of the proposed zoning ordinance map will be submitted to the City. Cost. $3,000 Task 4: Public Hearings PLANNING NETWORK will attend a maximum of four public hearings regarding the proposed development code and zoning map. Revisions to the development code requested by the Planning Commission and City Council during hearings will be prepared in addendum format. Following Planning Commission hearings, a revised document, incorporating all Planning Commission revisions will be prepared and submitted to the City Council for their hearings. As we discussed, the development code will have the following attributes: Authority for discretionary actions will be vested in the Planning Commission and City Council; only a few, minor approvals will be made at the staff level. Approval authority for permits and actions other than subdivisions, nonresidential parcel maps, and actions which are required by law to be made at City Council level will be vested with the Planning Commission. Staff actions will be appealable to the Planning Commission and City Council. Planning Commission actions will be appealable to the City Council. • The code will be quantitative in nature. Standards and review processes will be comprehensive and quantified. The standards included in code will ensure a high quality of development. • A preamble will be included, identifying the primary purposes of the development code, including maintaining environmental quality and enhancing the quality of life for the citizens of Diamond Bar. In addition, individual sections of the code will, as appropriate, include statements of intent and purpose. • The development code will contain clear sign regulations which will limit the size of signs to that necessary for identification of businesses. Included as part of sign regulations will be regulations for temporary signs and identifications signs for building complexes in addition to requirements for individual business signage. • Also included in the code will be hillside development regulations. • The development code will include provisions for architectural and design review, including standards and guidelines for site design, buffering, and landscaping. • The ordinance will be written in a formal rather than literary style. The consultant will meet with City staff and decisionmakers to review findings and outline recommended changes to these ordinances. Recommendations for format and content of the revised Development Code will also be prepared. Cost: $3,000 Task 2: Development Code Text PLANNING NETWORK will prepare a screencheck Development code based on the conclusions of Task 1. These revisions will be prepared as follows. 2.1 Procedural Requirements A draft development review system for the development code will be prepared. The development review system will be based on interviews with City staff, and will incorporate, revise, streamline, and/or formalize procedures presently used by the City, as appropriate. Where necessary, new review procedures will also be formulated. 2.2 Zoning Classifications and Definitions Zoning classifications and definitions (including overlay zones as appropriate) will be proposed to provide a realistic framework for implementation of a development review system. 2.3 Development Standards and Requirements PLANNING NETWORK will formulate new development standards and requirements in keeping with the desired character and quality of development for the City of Diamond Bar. This will include listings of permitted, conditionally permitted, temporary, and prohibited uses; densities and intensities of use; height, setback, and stepback standards; landscaping, parking, and sign requirements; and standards and requirements for special uses. Along with hearing on the General Plan, a revised zoning map will be prepared, if necessary, to achieve consistency between the proposed General Plan and zoning. With regard to past performance of Artistic Landscaping and Engineering Inc., the low bidder, we have ascertained that it is not the same firm, Artistic Landscape Maintenance, that has had poor past performance in Diamond Bar. With regard to the complaint filed by EGN Construction we have now received information from Artistic Landscaping and Engineering Inc., that they are in conformance with the specifications in that they will perform the concrete work themselves and Raymor Electric will do the striping and pavement markings. With these clarifications to their bid I am comfortable that they are in compliance with the specifications regarding percentage of work to be performed by themselves and sub contractors. Construction (Concrete Work), based on this information Artistic Landscaping would only be doing 19/ of the work, furthermore, they did not list anyone for the Coldmilling, nor the Stripping. If we consider these figures this would drop their portion of the work to 17/. We have not included their signal subcontractor in these figures, as this is a specialty item that all contractors will need a subcontractor for. The specifications for this project, clearly states the Contractor will be bound by the "Subletting and Subcontracting Fair Practices Act (Gov. Code Sec. 4100 and following)". In accordance with your specifications, and the fact that Artistic Landscaping will only be doing 17-19% of the work themselves, this project should be awarded to the second low bidder. WHEREAS, it is the intention of the City of Diamond Bar to construct certain improvements in the City of Diamond Bar. PREVAILING WAGE: Notice is hereby given that in accordance with the provisions of California Labor code, Division 2, Part 7, Chapter 1, Articles 1 and 2, the Contractor is required to pay not less than the general prevailing rate of per diem wages for work of a similar character in the locality in which the public work is performed, and not less than the general prevailing rate of per diem wages for holiday and overtime work. In that regard, the Director of the Department of Industrial Relations of the State of California is required to and has determined such general Page 1 prevailing rates of per diem wages are on file in the office of the City Clerk of the City of Diamond Bar, Suite 100, 21660 E. Copley Drive, Diamond Bar, California, and are available to any interested party on request. The Contracting Agency also shall cause a copy of such determinations to be posted at the job site. The Contractor shall forfeit, as penalty to the City of Diamond Bar, twenty-five dollars ($25.00) for each laborer, workman, or mechanic employed for each calendar day or portion thereof, if such laborer, workman, or mechanic is paid less than the general prevailing rate of wages hereinbefore stipulated for any work done under the attached contract, by him or by any subcontractor under him, in violation of the provisions of said Labor Code. In accordance with the provisions of Section 1777.5 of the Labor Code as amended by Chapter 971, Statutes of 1939, and in accordance with the regulations of the California Apprenticeship Council, properly indentured apprentices may be employed in the prosecution of the work. Attention is directed to the provisions in Sections 1777.5 and 1777.6 of the Labor Code concerning the employment of apprentices by the Contractor or any subcontractor under him. Section 1777.5, as amended, requires the Contractor or subcontractor employing tradesmen in any apprenticeable occupation to apply to the joint apprenticeship committee nearest the site of the public works project and which administers the apprenticeship program in that trade for a certificate of approval. The certificate will also fix the ratio of apprentices to journeymen that will be used in the performance of the contract. The ratio of apprentices to journeymen in such cases shall not be less than one to five except: A. When unemployment in the area of coverage by the joint apprenticeship committee has exceeded an average of 15 percent in the 90 days prior to the request for certificate, or B. When the number of apprentices in training in the area exceeds a ratio of one to five, or C. When the trade can show that it is replacing at least 1/30 of its membership through apprenticeship training on an annual basis statewide or locally, or D. When the Contractor provides evidence that he employs registered apprentices on all of his contracts on an annual average of not less than one apprentice to eight journeymen. The Contractor is required to make contributions to funds established for the administration of apprenticeship programs if he employs registered apprentices or journeymen in any apprenticable trade on such contracts and if other Contractors on the public works site are making such contributions. The Contractor and subcontractor under him shall comply with the requirements of Sections 1777.5 and 1777.6 in the employment of apprentices. Page 2 Information relative to apprenticeship standards, wage schedules, and other requirements may be obtained from the Director of Industrial Relations, ex -officio the Administrator of Apprenticeship, San Francisco, California, or from the Division of Apprenticeship Standards and its branch offices. Eight (8) hours of labor shall constitute a legal day's work for all workmen employed in the execution of this contract and the Contractor and any subcontractor under him shall employ with and be governed by the laws of the State of California having to do with working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code of the State of California as amended. The Contractor shall forfeit, as a penalty to the City of Diamond Bar, twenty-five dollars ($25.00) for each laborer, workman, or mechanic employed in the execution of the contract, by him or any subcontractor under him, upon any of the work hereinbefore mentioned, for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor more than eight (8) hours in violation of said Labor Code. Contractor agrees to pay travel and subsistence pay to each workman needed to execute the work required by this contract as such travel and subsistence payments are defined in the applicable collective bargaining agreements filed in accordance with Labor Code Section 1773.8. The bidder must submit with his proposal cash, cashier's check, certified check, or bidder's bond, payable to the City of Diamond Bar for an amount equal to at least ten percent (10%) of the amount of said bid as a guarantee that the bidder will enter into the proposed contract if the same is awarded to him, and in event of failure to enter into such contract said cash, cashier's check, certified check, or bond shall become the property of the City of Diamond Bar. If the City of Diamond Bar awards the contract to the next lowest bidder, the amount of the lowest bidder's security shall be applied by the City of Diamond Bar to the difference between the low bid and the second lowest bid, and the surplus, if any, shall be returned to the lowest bidder. The amount of the bond to be given to secure a faithful performance of the contract for said work shall be one hundred percent (100%) of the contract price thereof, and an additional bond in an amount equal to fifty percent (50%) of the contract price for said work shall be given to secure the payment of claims for any materials or supplies furnished for the performance of the work contracted to be done by the Contractor, or any work or labor of any kind done thereon, and the Contractor will also be required to furnish a certificate that he carries compensation insurance covering his employees upon work to be done under contract which may be entered into between him and the said City of Diamond Bar for the construction of said work. No proposal will be considered from a Contractor who is not licensed as a contractor at time of award in accordance with the provisions of the Contractor's License Law (California Business and Professions Code, Section 7000 et seq.) and rules and regulations adopted pursuant thereto or to whom a proposal form has not been issued by the City of Diamond Bar. The work is to be done in accordance with the profiles, plans, and specifications of the City of Diamond Bar on file in the office of the City Clerk at the City Hall, Diamond Bar, California. Copies of the plans and specifications will be furnished upon application to the City of Diamond Bar and payment of $5.00, said $5.00 is nonrefundable. Page 3 Upon written request by the bidder, copies of the plans and specifications will be mailed when said request is accompanied by payment stipulated above, together with an additional nonreimbursable payment of $5.00 to cover the cost of mailing charges and overhead. The successful bidder will be required to enter into a contract satisfactory to the City of Diamond Bar. With only 19 months left of our appointment the Committee is anxious to form work groups that would enable us to best use our various talents. Attached are 2 copies listing these areas. We as a Committee realize that some of the items overlap with other Commissions and Committees and would like the chance to work with them.
