City offices will relocate to Suite 100 in the Gateway
Center effective October 4, 1989. Therefore, it is
necessary to adopt a Resolution establishing the new
address for purposes of receiving mail.

4. RESOLUTION NO. 89 - XX: A RESOLUTION OF THE CITY

POSITION ON THE HOME MORTGAGE INTEREST DEDUCTION

5. ESTABLISHING POLICY REGARDING THE USE OF SPEAKERS'
CARDS FOR ADDRESSING THE CITY COUNCIL - As directed,
staff has prepared speakers' cards for the public's use
when they desire to address the Council on any issue.
Yellow cards have been developed for use by those
individuals wishing to speak in opposition to any
matter and green cards are for use by those wishing to
speak in support of any matter.
Recommended Action: Adopt a policy establishing the
use of yellow and green speakers' cards.
6. APPROVAL OF CITY LOGO
7. EMPLOYMENT OF CODE ENFORCEMENT OFFICER - The City
Council has determined that there is a necessity for
the City to employ a Code Enforcement Officer. There-
fore, staff is proposing the recruitment of a part-time
Officer to work twenty hours per week at the rate of
$13 - $16 per hour. There will be no fiscal impact as
this position would be transferred from the County.
Recommended Action: Approve recruitment and employment
of one part-time Code Enforcement Officer at the rate
of $13 - $16 per hour without benefits.
8. EXONERATION OF STORM DRAIN/DRAINAGE IMPROVEMENT SURETY
BOND - Request by County of Los Angeles for exoneration
of surety bond guaranteeing completion of storm drain/
drainage improvements to Private Drain No. 2060, Parcel
3 of Parcel [.lap No. 8174.
Recommended Action: Accept completion of storm drain/
drainage improvements and exonerate surety bond in the
amount of $87,000.
9. EXONERATION OF SANITARY SEWER IMPROVEMENT SURETY BOND -
Request by County of Los Angeles for exoneration of
surety bond for sanitary sewer improvements, Private
Contract No. 10551, Tract No. 42572.
Recommended Action: Accept completion of sanitary
sewer improvements, accept the sanitary sewer for
public use and exonerate the bond in the amount of

11. RESOLUTION NO. 89 - XXi A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF DIAMOND BAR ESTABLISHING A
CONFLICT OF INTEREST CODE FOR DESIGNATED CITY PERSONNEL
The Political Reform Act of 1974, as amended, requires
cities to adopt a Conflict of Interest Code for desig-
nated personnel. The City Attorney is recommending
that the incorporation by reference of the terms of a
standard model Conflict of Interest Code and amendments
be approved.
Recommended Action: Adopt Resolution No. 89 - XX
establishing a Conflict of Interest Code for Designated

CONSENT CALENDAR
12. PURCHASE OF COMPUTER SYSTEM FOR FINANCIAL OPERATIONS -
During discussions among staff, Council members and computer
consultants, it was determined that the City would best be
served by separating the financial operations from the
computer needs of the remainder of City Hall. Since the
previously -authorized purchase of CAS software for financial
operations requires specific hardware, it was agreed that the
financial package could only be provided by one vendor --
Computer Applied Systems. Informal bids will be requested for
hardware and software needed for other City Hall functions
-- word processing, Lotus, records management etc.
Recommended Action: It is recommended that the City Council
approve a contract (subject to approval by the City Attorney)
with Computer Applied Systems for provision of hardware and
software in an amount not to exceed $18,000.

AGENDA REPORT
Background: The City Council has determined that there is a
necessity for the City of Diamond Bar to employ
it's own Code Enforcement Officer.
PROPOSAL: Staff would propose recruitment of a part-time
Code Enforcement Officer to work a maximum of
twenty (20) hours per week at the pay rate of
thirteen dollars ($13) to a maximum pay rate of
sixteen dollars ($16) per hour. This pay rate is
based upon the results of a survey conducted by
Staff wherein the following Cities were surveyed:
West Covina Arcadia
Claremont Glendora
E1 Monte Covina
The recommended salary is an average hourly rate
based upon the rate paid by each of the above cities.
Staff would recommend the following job description
and requirements for said position:
Job Summary: Enforces the City's codes including
zoning, property maintenance, health, land use,
public nuisance and other aspects of the Municipal
Code. Interprets and explains laws and regulations
to the general public to gain voluntary conformance;
issues notices and orders of compliance; issues
citations and recommends legal prosecution of persons
who fail to respond; appears before the City Council
to explain enforcement matters; coordinates legal
action with the City Attorney; and related work as
required.

Examples of Duties: Enforce a variety of occupancy,
public nuisance, zoning and land use regulations
such as those for commercial stores, contractors and
subcontractors, motels, trailer parks, and residences.
Issues citations and explains violations to those who
perpetrate them.
Inspects premises to verify type of business and detect
and advise property owners of violations of City Code
provisions.
Inspects trailer courts and mobile home parks in regard
to health, safety, public nuisance, or other Code
violations.
Checks transient business activities such as delivery
vehicles, solicitors and pellers for compliance with
Code regulations.
Checks businesses for proper display of business licenses
and business tax certificates.
Responds to complaints of alleged violations and
thoroughly investigates such complaints.
Investigates suspected violations of health, safety,
zoning, public nuisance, or other code violations and
take follow-up actions as necessary to assure compliance.
Enforces and administers City Ordinances with regard to
home occupations, non -conforming land uses, commercial
signing, property maintenance, and related codes and
ordinances.
Testify in court and public hearings as required.
Maintain inspection files and records.
Writes reports, chronologies, and citation narratives,
maintains daily statistical logs.
Qualifications: Knowledge of Municipal government;
City laws and ordinances; methods used to gain voluntary
or legal compliance of violations.

property owners and others in a courteous and effective
manner.

of local codes and ordinances.

SUBJECT: CARLTON J. PETERSON PARK - AWARD OF BID
On September 13, 1989 at 2:00 p.m. bids for the construction of Carlton J. Peterson Park were
received and publicly opened as required by law.
The low bid was $521,595.96 which is $109,195.96 more than the Engineer's Estimate. This
"high" bid prompted us to request extra time to carefully examine the bids, plans, specifications
and options.
At the Council meeting of September 19, 1989 RKA was directed to review said bids, plans
and specifications to determine alternatives to consider in developing the subject park in
substantial conformance to the plans and within available funds.
There appears to be two basic options at this point, and that is to take out some of the less
essential items and award a contract that would be within available funds or take additional
time of about 30 days to revise the plans which would eliminate, substitute and/or modify some
of the items, but still result in a completed park in substantial conformance to the original plan.
the major items of the two options are outlined below. The significant areas of our concern
are the proposed drainage facilities and the extremely high bids received for the "room
addition". We believe there can be realized significant savings in these areas by a significant
redesign and separate bidding respectively.

This would result in a new low bid of $431,505.96. With this option there would be a need
to modify the gunite swale to compensate for the removal of the storm drain system. This
would result in appropriating an additional $5,000.
The room addition is necessary to the use of the park. We would recommend setting aside
$20,000 and rebiding the room addition.
The $20,000 for the room addition, $5,000 for extra work as a result of removing the storm
drain and the new low bid of $431,505.96 would put the total cost of the park at $456,505.96.
OPTION #2: Reject Bids and allow RKA to modify plans and specs to reduce the cost of
the project. We feel there are a number of items that can be modified or eliminated that
would result in a lower bid without sacrificing the integrity of construction or recreational
value of the park.
Some of these areas are as follows:
• Reduce brickdust in infields from 8" to 3" layers.
• Remove sand/aggregate base from concrete sidewalks.
• Reduce standard in chain link fencing posts to "or equal"
• Remove litter can holders from base bid and use Alternate #7.
• Eliminate he storm drain system and modify gunite swale.
• Reduce liquidated damages from $300 per day to $200 per day.
• Modify specifications in areas of regulating agencies, sample submittal, some tests
and other items.
• Reduce requirement of light weight slump stone blocks to regular slump stone or split
face.
• Reword specifications to "set soccer field corner ports" and eliminate any further
wordage.
• Eliminate any parking lot modifications.
• Eliminate the room addition and bid separately and/or place as additive alternate.
• Remove the raised planter walls completely.
• Bid flagpole installation as additive alternate.
• Eliminate the need for the contractor to provide an office on-site.
• Eliminate the storage structure from the basic bid and make it an additive alternate.
• Eliminate the need for the contractor to provide a telephone on-site.
• Eliminate bike racks from park. These can be installed later with bikeway money.
• Eliminate the decorative granite boulders from around Tot Lot.
Option #2 would require the formal rejection of bids, time for plan and specification
modifications and readvertising, which would push the construction start date back another
60 days minimum.
The Council also directed RKA to explore the possibility of providing a wall along the park's
property line that abuts the Pomona Freeway, as a protective device against vehicles that
might come off the freeway and into children playing at the park.

We have examined the area and concur that some protection should be provided. We would
therefore provide the following recommendations in the order of our preference:
1. Once the vehicle leaves the road surface of the freeway it will be difficult to stop. The
best option is to keep the vehicle on the roadway. With this in mind, we suggest
working with Caltrans to have a barrier wall along the edge of the roadway in front of
the park. This would keep vehicles on the roadway.
2. If Caltrans won't agree to a permanent barrier, we would request they consider the use
of the temporary barriers similar to what is commonly used in the center of most
freeways.
3. Erect a 5' high berm with a 6' chain link fence parallelling the property line, ten feet in
on the park side from the toe of the freeway slope.
4. Erect a protective wall structure along the property line that abuts the freeway at a cost
of roughly $200,000.00.
5. Erect a 14' high block wall along the property line at a cost of roughly $90,000.00. The
problem with this option is that if a vehicle hits the wall, it will shatter the wall causing
masonry projectiles to be thrown towards the park. The wall could also give way and
possibly cause bodily injury. We would recommend Option #4 if a wall is desired.
At the request of the City Council, Caltrans will install a guardrail along the west bound
roadway adjacent to Carlton J. Peterson Park.
RECOMMENDATION:
It is recommended that the City Council award the contract to General Procurement Co. of
Costa Mesa for Bid Items # 1, 2, 3, 8, 9, 10, 11, 16, 20, 21, and 22 for a total contract price
of $431,505.96.

Enclosed herewith please find the following documents
pertaining to the above issue:
1. A Notice of Public Hearing regarding the matter
with an unspecified date for the hearing. we recommend that
the document be published as well as individual copies provided
to each of the individual persons listed in the disclosure
requirements under Appendix "A".
2. A form of Resolution regarding adoption of a
code by reference pursuant to the Political Reform Act.
3. Appendix A and Appendix B indicating the
designated employees and the various disclosure categories
pertinent to those employees.
