COPLEY DRIVE, SUITE 330 DIAMOND BAR, CA 91765 714 -860 -CITY 714-860-2489 WALNUT VALLEY WATER DISTRICT WATER AWARENESS WEEK PROCLAMATION WHEREAS, water is California's most precious natural resource, and; WHEREAS, the state has experienced two consecutive critically dry years, and; WHEREAS, the drought has demonstrated the significance of water to the health and welfare of all our communities, and; WHEREAS, to ensure an ample supply of good quality water for our residents, we must work together to effectively conserve and protect the local water resource, and; WHEREAS, during the week of Hay 1, the CITY OF DIAMOND BAR joins with the WALNUT VALLEY WATER DISTRICT to work to increase understanding of water; NOW, THEREFORE, BE IT RESOLVED, that the CITY OF DIAMOND BAR does hereby proclaim May 1-7, 1989 as Water Awareness Week and urges all citizens to join with them in supporting the WALNUT VALLEY WATER DISTRICT in their efforts to help Californians be water aware. COPLEY DRIVE, SUITE 330 DIAMOND BAR, CA 91765 714 -860 -CITY 714-860-2489 CITY OF DIAMOND BAR DAY OF THE TEACHER PROCLAMATION WHEREAS, the Legislation has declared Public Schools Week during the month of Hay; and WHEREAS, The Governor has proclaimed May 10 as the Day of the Teacher for 1989; and WHEREAS, the City Council and the community are extremely proud of the many fine teachers who serve the students in Diamond Bar; and WHEREAS, said teachers are talented and dedicated professionals who are interested in the welfare and well-being of each of the students whom they serve; and _ WHEREAS, the accomplishments of teachers have a life long effect upon the children with whom they work; and WHEREAS, the schools and teachers have a primary role in the attainment of that potential; and NOW THEREFORE, BE IT RESOLVED that I, PHYLLIS PAPEN, Mayor of the City of Diamond Bar do hereby proclaim Hay 10, 1989 as the Day of the Teacher and call upon the community to join in giving special recognition and thanks for the outstanding contributions teachers have made to the lives of our students, our community, and our nation. PROCLAMATION WHEREAS, Hay 1st is Law Day U.S.A. in the United States of America; and WHEREAS, The United States of America has been the citadel of individual liberty and a beacon of hope and opportunity for more than 200 years to many millions who have sought our shores; and WHEREAS, The foundation of individual freedom and liberty is the body of the law that governs us; and WHEREAS, The Constitution of the United States of America, and the Bill of Rights, are the heart of that body of law, which guarantees us many freedoms - including freedom of religious belief, freedom of assembly, freedom of speech, freedom of press, freedom of petition, and due process of law among others; and WHEREAS, This year marks the 32nd annual nationwide observance of Law Day, and the Congress of the United States and the President by official proclamation have set aside May 1 as a special day for recognition of the place of law in American life. NOW, THEREFORE, the Council of the City of Diamond Bar, California, do hereby designate May 1, 1989, as Law Day U.S.A. and call upon all citizens, schools, businesses, clubs, and the news media to commemorate the role of law in our lives. DATED: PHYLLIS PAPEN Mayor MINUTES OF THE FIRST MEETING OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR HELD APRIL 18, 1989 Welcome: Supervisor Peter Schabarum opened the meeting with encouraging remarks to all in attendance. Colors: Troop 777 Boy Scouts presented the colors. Pledge of Allegiance: Jerry Harper, Assistant Sheriff for Los Angeles County led the flag salute and pledge. Invocation: Rabbi Elisha Nattive, Temple Shalom gave an inspiring invocation. Certificates Supervisor Schabarum recognized Ruth Bennell, Executive Office LAFCO presented a Certificate of Completion to the City. Oath of Offices Supervisor Schabarum introduced Robert Martinez, Superior Court, Judge, who administered the oath of office to each Council member. Election of Mayor: Supervisor Schabarum noted the first order of business was to elect a Mayor from among the Council members. Councilman Forbing moved to place in nomination the name of Phyllis Papen. There were no other nominations. Councilman Werner moved that nominations be closed. The motion was seconded by Councilman Horcher and unanimously carried. Phyllis Papen was elected Mayor. Mayor Papen assumed Chairmanship of the meeting. Election of Mayor Pro -Tem: Mayor Papen opened nominations for Mayor Pro -Tem. Councilman Miller moved to nominate Councilman Horcher for Mayor Pro - Tem. There were no other nominations. Councilman Miller moved that nominations be closed. The motion was seconded by Councilman Forbing. Mayor Papen declared that Councilman Horcher was elected Mayor Pro -Tem. Devotion: Mayor Papen asked Rev. Richard Engdahl, Northminster Presbyterian Church to give the devotion. Presentations: Mayor Papen read a letter of congratulations from Governor George Deukmejian. Mayor Papen then read a letter of congratulations from Senator Pete Wilson. Mayor Papen then recognized Mark Harmsen representing Congressman David Dreier, who read a congratulatory letter from Congressman David Dreier. Mayor Papen then recognized Senator William Campbell who presented a Resolution of the State Senate to the City of Diamond Bar. Mayor Papen recognized Bruce Butler representing Assemblyman Frank Hill who presented a California State Flag. Mayor Papen recognized the Mayor of Walnut Drexel Smith who presented to the City a plaque from the City of Walnut. Mayor Papen recognized Mayor John Ferrero of the City of Industry. Councilman Perez representing the City of Industry presented a plaque to the City of Diamond Bar. Mayor Papen asked Mayor Pro -Tem to read a resolution from the City of Westlake Village. Judy Hathaway and Al Perez representing California Contract Cities Association presented a plaque to the City. Mayor Papen recognized the Diamond Bar Incorporation Committee. Ivan Nyal representing the Committee presented a plaque to each member of the City Council. Mayor Papen recognized the Diamond Bar Chamber of Commerce. Dianne Forbing representing the Chamber presented the City with an American flag. Mayor Papen recognized the Diamond Bar Rotary. Tom Bandy representing the Rotary Club presented a California State flag to the City. Mayor Papen recognized the City Attorney. Mr. Andrew Arczynski representing the firm of Markman, Arczynski, Hanson and Goldman presented the Mayor with an inscribed gavel. Mayor Papen recognized Alan Newman and Becky Owens representing the San Gabriel Valley Tribune who presented the city with copies of the special edition showing the history of Diamond Bar and addressing the incorporation celebration. Mayor Papen recognized Peter Von Schneer representing the Ramada Inn who presented the Mayor with a bouquet of red roses. Mayor Papen then offered the members of the City Council an opportunity to speak to the people of Diamond Bar. Councilmen Forbing, Miller, Werner and Horcher each thanked and recognized various people for the help and assistance. Mayor Papen recognized and thanked many people for their help and assistance. Mayor Papen asked Reverend Father Michael La Nier for the Benediction. Mayor Papen announced a recess of the meeting. The meeting reconvened at 9:30 P.M. Councilman Forbing moved to approve the consent calendar. Councilman Werner seconded the motion. Mayor Papen asked to have Resolution #19 removed for further discussion. All items on the consent calendar except Resolution #19 were adopted by unanimous vote. The provisions of Resolution #19 were discussed by the Council and City Attorney. Councilman Miller moved adoption of Resolution #19 the motion was seconded by Councilman Werner and carried by the following votes AYES: Councilmen - Werner, Forbing, Miller and Horcher NOES: Councilmen - Mayor Papen ABSENT: Councilmen - None Mayor Pro -Tem was unanimously elected to be the Alternate Delegate to the County Sanitation District for the City of Diamond Bar. Councilmen Forbing and Miller were appointed to on a Sub -committee for Recreation and Parks purposes. The location and time and date of Council meetings was announced. Council asked for various information regarding traffic improvement items, traffic studies and analysis of traffic signals as it becomes available. It was moved by Councilman Werner, seconded by Councilman Horcher to adjourn. Meeting was adjourned at 10:35 P.M. RESOLUTION NO. gq_m A RESOLUTION OF CITY COUNCIL OF THE CITY OF DIAMOND BAR ADOPTING THE 1988 EDITION OF THE STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION AND 1985 EDITION OF THE STANDARD PLANS FOR PUBLIC WORKS CONSTRUCTION WHEREAS, members of the Southern California Chapters of the American Public Works Association and the Associated General Contractors of California working as a Joint Cooperative Committee have prepared the 1988 Edition of the Standard Specifications for Public Works Construction and the 1985 Edition (First Edition) of the Standard Plans for Public Works Construction; and WHEREAS, a uniformity of standards will serve to minimize conflict and confusion in public works construction and will tend to lower construction costs for future public works projects through com- petitive bidding by private contractors; and WHEREAS, the Director of Public Works of Los Angeles County was represented on the Committee which prepared the 1988 Edition of the Standard Specifications for Public Works Construction and the 1985 Edition of the Standard Plans for Public Works Construction and recom- mends their adoption. These figures are based on the current park program that we operate in Walnut. Recreation Leaders would work from 10 am - 4 pm, Monday through Friday, beginning on June 19. This would be a drop-in recreation program, and not a full service child care program, which we now offer at Castlerock Elementary, Maple Hill Elementary, and Quail Summit Elementary in Diamond Bar. Payment could be made to Walnut Valley Recreation in the same fashion that Walnut now pays for their park program: At the end of each month, Walnut Valley Recreation would invoice the City of Diamond Bar for exact payroll costs, supply costs, and administrative overhead, not to exceed the projected amounts listed on the attached proposal. The City of Diamond Bar would then reimburse Walnut Valley Recreation for their expenses. The 30% of administration covers a percentage of the Parks Supervisor's salary, clerical time for processing payroll and requisitions, and a percentage of the brochure and advertising costs (which we charge back to all of our programs). As there are no facilities to store recreation equipment, (balls, bats, table games, craft supplies, etc), we are recommending that Diamond Bar putrhase some portable metal sheds, which cost around $1200. These sheds have a walk-in front door, which can be locked. Similar sheds were purchased for Walnut and can be placed on grass areas on redwood ties, and are virtually vandal -proof. These would be the property of Diamond Bar, and can fit in well with the park design. A. Recitals. (i) The City Council has heretofore adopted, by reference, Title 26 of the Los Angeles County Code, as amended by Ordinance No. 87-0177 of the Board of Supervisors. As the City continues to recruit for qualified people the matter of benefits will be important. Almost every City in California has the Public Employees Retirement System in effect, and people will be interested in the ability to continue in the system. It is recommended that the City Council approve an investigation into the details of a contract between the City and P.E.R.S. As an option the Council may wish to have the Personnel sub -committee report on the plan. Each payment would be $6,437.88 after an $18,370.00 first payment. This is an interest rate of 12.16%. Another option would be payment of $36,740.00 now and a payment of $38,025.90 on August 9, 1989. This would be an interest rate of 10.5% with finance charges of $1,285.00. I believe we could manager the two payment plan comfortably.
