HomeMy WebLinkAboutRES 91-37RESOLUTION NO. 91 -37- A 1 -37- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO. 1668 UNIT 11 IN THE CITY OF DIAMOND BAR FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF. WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as PRIVATE DRAIN NO. 1668 Unit II, described in Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operations, maintenance, repair and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated June 20,1989, and recorded March 20,1990, as Document Number 90-545570, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage systehi described in Exhibit A attached hereto from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair and improvement. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit A. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and Contractor will meet with representatives of Foothill Transit, the Southern California Rapid Transit District, Los Angeles County Transportation Commission and the Pomona Valley Transportation Authority as needed to insure that the recommended service does not duplicate, existing public transportation services and enhances mobility for the citizens of the City. Contractor will also work with the 'above agencies to secure transfer agreements as necessary. 5.2 Phase 1 Reports As part of the Contractors responsibilities under Phase 1, the Contractor will be required to produce two formal reports. A draft report containing the various recommendations required to implement the operations will be required within forty-five days after the execution of the contract between the City and the Contractor. After receiving direction from City staff and Committees, the Contractor will prepare a final report within 20 days of receiving direction from the City. The Contractor will be required to provide at least one formal presentation on both the draft and final report. Phase 1 will be considered complete upon formal acceptance of the final report by the City. No payments will be made for Phase 1 work until the final work is accepted. Acceptance of the work is entirely at the discretion of the City. The City shall retain the right to request expansion on or additional information on any section of the reports. f 5.3 Phase 2 - Operations Upon final approval of Phase 1, the Contractor shall have 45 days to implement the transit system approved by the City as part of the Contractor's final report. The various details of the operation, including hours of service, number of vehicles, total service levels, etc. are subject to change and refinement during Phase 1. It is expected that the Contractor will initiate operations start- up activities concurrently with the performance of work under Phase 1, as the various operational policy decisions are made by the City. The Scope of Work for the operations of the FRD transit system is hereafter presented to allow Contractors to present a reasonable proposal. The quantity and quality of services described herein should be used by the Contractor as the basis of the work completed under Phase 1, but can change upon approved recommendations of the Contractor or direction by the City. Contractors must utilize the levels of service described to prepare their price proposals. The rate structure payable to the Contractor has been designed to allow flexibility in the provision of alternate service levels. 28 ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights of way for said drain now vested in the City and all other necessary rights of way therefore have been conveyed to and accepted by District. Reference is hereby made to District Drawings No. 313-F80.1-80.2, the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. i BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated June 20, 1989, and recorded March 20, 1990, as Document Number 90-545570, of the Official Records in the office of the County Recorder for the County of Los Angeles. No. 1668 Unit I, Station 0+00.00 located in Montefino Drive, Westerly of Diamond Bar Boulevard; thence northeasterly in Montefino Drive to a 10 -foot -wide easement for storm drain and storm drain ingress and egress purposes, which lies within Lot 1 of said tract; thence northeasterly in said easement to a catch basin, Station 1 +90.88, a distance of 191 feet, more or less.
