HomeMy WebLinkAboutRES 91-29RESOLUTION NO. q l -:29 A RESOLUTION OF THE CITY COUNCIL OF THE DIAMOND BAR DENYING THE APPEAL OF THE PLANNING COMMISSION DENIAL OF THE EXTENSION OF TIME REQUEST FOR C.U.P. 86=410 FOR THE PROPERTY LOCATED AT 1200 SOUTH BREA CANYON ROAD, DIAMOND BAR, CALIFORNIA. A. Recitals. (i) On January 14, 1991, the Planning Commission of the City of Diamond Bar, at a duly noticed public meeting, considered, deliberated and determined to deny the request for time extension submitted by Mr. Stephen Chung for the previously approved office building to be constructed at 1200 South Brea Canyon Road. (ii) The project proponent appealed the decision of the Planning Commission, which appeal was considered by the City Council of the City of Diamond Bar at a duly noticed regular meeting of the City Council held on April 16, 1991. At such time, public testimony was received and the Council continued the matter to May 21, 1991, to allow an opportunity for the proponent to provide revised architgctural and site plans. Such revised plans were to respond to the issues and concerns identified in the course of the hearing. (iii) At the conclusion of the hearing on the matter held on May 21, 1991, the City Council of the City of Diamond Bar determined that the projectas proposed and as revised failed to 1 respond to the various issues raised and, thereupon, determined and resolved that the appeal of the denial of the request for an extension of time for C.U.P. 86-410 should be denied. (iv) All required procedures and conditions necessary for the adoption of this Resolution have occurred. B. Resolution. THE CITY COUNCIL OF THE CITY OF DIAMOND BAR HEREBY RESOLVES as follows: 1. In all respects as set forth in Section A, Recitals hereinabove. 2. The appeal of the Planning Commission decision to deny an extension of time for C.U.P. 86-410, located at 1200 South Brea Canyon Road, both as originally requested and as revised, is denied. The denial is based upon the determination of the Council that the project, both as proposed and as revised, is unsuitable for the site in that the project will create deleterious impacts given the present circumstances of the subject property. 3. The City Clerk shall certify to the adoption of this Resolution. PASSED, ADOPTED AND APPROVED this 4th day of June, 1991.
