A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DIAMOND BAR DECLARING ITS INTENTION TO DENY A
DEFENSE TO CITY COUNCIL MEMBERS RELATING TO
CERTAIN LAWSUITS ALLEGING LIBEL OR SLANDER AND
DECLARING SAME TO BE OUTSIDE THE SCOPE OF DUTY
WHEREAS, Part 7 of Division 3.6 of the California Government Code, commencing at Section
995, sets forth certain requirements for the provision of a defense to City Council Members who
are acting within the scope of the duties of their office, and
WHEREAS, the City Council of the City of Diamond Bar wishes to clearly identify and define
certain actions which arc not to be considered as being within the scope of duties of office, and
not to be defended at public expense,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Diamond Bar
declares its intention that the City shall not provide a defense at public expense to any City
Council Member if the cause of action relates to an allegation of libel or slander through the
publication of a communication of general circulation which has not been sponsored and
authorized by the City of Diamond Bar, and which shall not be considered an activity within the
scope of duties of that City Council member.
PASSED, ADOPTED and APPROVED by the City Council of Diamond Bar, California, this
16th day of August , 1994.
