A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DIAMOND BAR ADOPTING A NONDISPOSAL FACILITY
ELEMENT AS REQUIRED BY ASSEMBLY BILL 3001
A. Recitals.
(i) The California Integrated Waste Management Act of 1989
(Assembly Bill 939) requires each city to prepare, adopt, and implement a Source
Reduction and Recycling Element (SRRE) which identifies how each city will divert,
through a combination of source reduction, recycling, and composting programs, 25%
of solid wastes from landfill disposal by 1995, and 50°x6 by the year 2000.; and
(ii) In 1992, the California Legislature enacted Assembly Bill 3001
(Cortese) which amends this Act by requiring cities and counties to prepare and adopt
another Element, a Nondisposal Facility Element (NDFE); and
(iii) California Public Resources Code Section 41730 et seq, requires
every city to identify and provide a description of all new nondisposal facilities, and any
expansions of existing facilities, which will be needed to implement the city's Source
Reduction and Recycling Element (SRRE); and
(iii) A Nondisposal Facility is defined by California Public Resources
Code Section 40151 as any solid waste facility required to obtain a state solid waste
permit (i.e., transfer stations, materials recovery facilities, and composting facilities)
other than a solid waste disposal and transformation facility; and
(iv) On May 17, 1994, the Diamond Bar City Council held a duly
advertised public hearing on the Nondisposal Facility Element and the opportunity was
given to all persons present to speak.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DIAMOND BAR
DOES HEREBY FIND; DEFTERMINE AND RESOLVE AS FOLLOWS:
SEQTIOt'4 °i: Tho City, in accordance to Public Resources Code Section 41730,
has now prepared'a 41on0sposal Facility Element (NDFE) for all nondisposal facilities
that the City pt"ans ,to use now and in the future to implement its Source Reduction and
Recycling Element (SRRE); and
SECTION 2: The City has submitted a draft of the Nondisposal Facility Element
(NDFE) to the County of Los Angeles Solid Waste Management/Integrated Waste
Management Task Force (LTF) for their review and comment pursuant to California
Public Resources Code Section 41734(b), and has addressed the LTF's comments to
the extent practicable; and
SECTION 3: The City intends to append the Nondisposal Facility Element
(NDFE) to the City's Source Reduction and Recycling Element (SRRE) at the time of
the five year revision; and
SECTION 4: The City Clerk shall certify to the passage of this Resolution by the
Diamond Bar City Council and it shall thereupon take effect.
