HomeMy WebLinkAboutRES 95-18RESOLUTION NO. 95-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DIAMOND BAR, CALIFORNIA, SUPPORTING SENATE BILL 387 (MOUNTJOY) PROHIBITING AN ENFORCEMENT AGENCY FROM ISSUING A SOLID WASTE FACILITY PERMIT FOR A MATERIAL RECOVERY FACILITY, IF THE FACILITY MEETS SPECIFIED CONDITIONS, AS DEFINED WHEREAS, the City of Industry and the Industry Urban -Development Agency have proposed the location of a material recovery facility within 1,500 ft. within the City of Diamond; and WHEREAS, it has been determined that the location of such a material recovery facility in close proximity to the city residences and city roadways would create significant unmitigatable environmental impacts upon the people of Diamond Bar, and WHEREAS, the cities of Walnut and Diamond Bar have been working cooperatively in an effort to cause the relocation of the proposed material recovery facility to an area within the City of Industry which would have the least amount of impact on the respective communities of Diamond Bar and Walnut; and WHEREAS, legislation has been introduced by Senator Richard Mountjoy, entitled Senate Bill 387 (Mountjoy), which would prohibit an enforcement agency from issuing a solid waste facility permit for a material recovery facility if said facility has unmitigated environmental impacts on at least one neighboring community where 60% or more of the land -use has been designated for residential uses. NOW, THEREFORE, be it resolved that the City Council of the City of Diamond Bar does hereby support the passage of Senate Bill 387 (Mountjoy) and encourages State Legislators to give Senate Bill 387 (Mountjoy) favorable consideration. NOW, THEREFORE, BE IT FURTHER resolved that the City Council of the City of Diamond Bar does hereby authorize the Mayor to communicate the City of Diamond Bar's support of Senate Bill 387(Mount oy) through written communication and by appearing before any legislative committee which considers Senate Bill 387 (Mountjoy).
