HomeMy WebLinkAboutRES 2005-23RESO ON NO. 2005-23 A RESOLUTION OF THE CITY CO CIL OF THE CITY OF DIAMOND BAR, DETERMINING THAT UNDERGROU DING, IN THE SPECIFIED AREA, IS IN THE GENERAL PUBLIC INTEREST A ESTABLISHING THE BREA CANYON ROADIWASHINGTON STREET UNDE GROUND UTILITY DISTRICT A. Recitals (i) WHEREAS'Division 1, Chapter 13.04 of the Diamond Bar Municipal Code establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to asce ain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures an the underground installation of wires and facilities for supplying electric, communication, or similar or associated service for the Brea Canyon Road/Washington Street area of the City of Diamond Bar, as more particulat ly described in this Resolution; and (ii) WHEREAS, a public hearing was called for May 3, 2005 at 7:00 pm at the South Coast Air Quality Management District Main Auditorium, 21865 Copley Drive, Diamond Bar, California, to ascertain whether the public necessity, safety, health, or welfare requires the removal of poles, overhead wires, and a sociated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service on Brea Canyon Road and Washington Street in the area specified in Exhibit A; and (iii) WHEREAS, notice f such hearing has been given to all affected property owners as sh wn on the last equalized assessment roll concerned in the manner and fort e time required by law; and (iv) WHEREAS, notice ofsuch hearing was posted in the manner and for the time required by law; a d (v) WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. B. SECTION 5. The City Council resolves that all poles, overhead wires and associated overhead st uctures shall be removed and underground installations made in said underground utility district within the following times: 2005--23 (a.) Underground in 2007; allation and reconnections not later than January I, (b.) Removal of poles, overhead wires and other associated structures not later than January 11, 2007; SECTION 7. The City Clerk shall certify to the adoption of this Resolution and, within ten (10) days after the adoption of this Resolution shall mail a copy of this Resolution to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities.
